HI,

I am inside canada on ICT visa (home business transferred to Canada). My wife on SWOP . I am the primary applicant and wife is dependent.
My company is registered in British Columbia but my agency has done one mistake of making me primary applicant.
As I am undergraduate and dont have skill in writing IELTS. Hence I cant get meet my Score for Express Entry.
My question is as my wife is Graduate and will be confident in IELTS can I change her to Primary applicant as we are both directors of the registered firm.
Please help.

Since you are primary applicant for the visa process and her on spouse visa...In order to make her primary applicant you have to start the process from scratch...

The fact that you are both working and got WP for your own business can also be problematic. Had your spouse been working in your home country for the business? How long had the business been open in Canada or was it created solely for immigration purposes? How many employees does your business have abroad and in Canada other than you and your spouse? Has the business been profitable in the past 5 years for example? Does your partner’s education and work history make her a good candidate to be a director? Will you be counting extra points for the job offer towards express entry?

Yes My spouse was director in home country too with 50% share.
She has graduation and has done WES. So we can claim 200 points extra that is applicable for ICT primary applicant.

Agency has the same opinion too. So they are charging us the same fees what we paid at the time of application.
how much it cost?

How many employees are in the Canadian business and do you have multiple years showing that business has been profitable? There will increased scrutiny in order to verify that this is a business that makes sense to operate and not a business created solely to try to immigrate or to hire family members who don’t have the education and work history to justify hiring. Both situations are not uncommon so IRCC scrutinizes applications that involve family members and family businesses more than working for a 3rd party.

Yes back in home country we ran in profit.
You must show that Canadian part of the business is profitable and preferably multiple years of financials. How long has the Canadian arm of the company been operational and has it been profitable and can you show that this is a viable business?The fact that the company consists of 3 employees and two of them are using the company to get permits to be in Canada means that essentially you created the Canadian arm of the company to facilitate your immigration. If there is only one other employee calling the other 2 co-directors has minimal significance because there is only one employee. Having a company with 3 employees and 2 of them are a couple trying to secure PR may be very difficult especially if you can’t show proof of financial reports showing this business activity and that this is a profitable business. It is actually pretty lucky that you were able to get WP to begin with but getting PR may be much more challenging since IRCC is looking out to businesses that are solely being created as a means to immigrate and aren’t viable businesses.
