Hi There,

my husband is on work permit here in Canada. We got married at the end of 2008, around the same time my husband was charged with Theft under $ 5000 ( from the employer). we have hired a lawyer and he is working on getting the charges withdrawn as its my husband's first offence. we have already submitted the Sponsership application and have disclosed this info by attaching the document stating the charges. We have applied from outside of canada. My part of the application has been approved and now its gone for processing to my husband's home country. my question is that will the charges come in the way of him getting the permanent Residency, will this cause any delays in the processing of the application.

Please advise

thanks

Please note that he will not be eligible for rehabilitation until the prescribed amount of time has passed since he satisfies the conditions of his sentencing - that will be either 5 years or 10, depending on the offence. If there is no conviction, it's a different matter - or if he receives a Minister's pardon.

thanks for the input. At this very moment, he is only charged, not convicted, and its been only 3 months and there has been only one hearing so far. My question is not as to if he will be sentenced or convicted, rather its about if his being charged will cause any delays??
