I need your advice

Hello,

I am currently finishing my Master's degree at one of the Universities of Ontario. I am a civil engineer specializing in the geotechnical area. Originally I am from Russia and I am staying in Canada under TRV and study permit now. I have the job offer from one of the Canadian employers at the geotechnical company. My question is the following. My Serbian boyfriend is coming over for a visit this summer and we are going to get married in Canada. After that I was planning to get an employment and apply for a post graduation work permit (or maybe a regular work permit is a better option for me, I am not sure). I don't want us so be separated, so I searched the options and found out that he can apply for TRV from Serbia as my husband so that he will be able to come to visit me for no longer than 6 months. Do I need to write an invitation for him? I am not a permanent resident or a citizen yet.
There was also mentioned that he can apply for the work permit as my spouse if I am "authorized to work in Canada for six months or longer" and if the work I am doing meets a minimum skill level. Both conditions are satisfied.
Can he apply for a permanent resident while staying in Canada? Can he do it together with me in one application if I am qualified as a Skilled worker or he needs to submit his own one?
Will it be easier for him to come here if he gets a job offer from Canadian employer and applies for a work permit from Serbia?
I am asking so many questions cause I really want him to be here with me and I want to make it neat and without any violations of Canadian immigration rules. And I am also concerned what should we do if his application would be rejected.

He can apply for a TRV to stay with you after you are married and he can probably apply for an open work permit to work as your spouse but he has to prove that he will leave Canada at the end of his permits like for any temporary permit.

If one of you qualifies to apply for PR under PNP or under FSW and you are already married, then you can apply together as a couple.

Hi again Leon,

Thank you very much for your reply. So, here is the plan- he comes to Canada as a visitor, we get married, then I apply for FWS PR as a main applucant and include all his documents. He goes back to Serbia, and applies for TRV as my spouse, comes here again as a visitor and stays for 6 months with me while we are waiting for the decision regarding TR. Can he extend his stay after 6 months because we applied together for PR or he will need to leave Canada anyways and wait till the time we get PR status to be able to come back? I haven't seen any requirements regarding how frequently he can come to Canada as a visitor if the TRV won't be extended (or how long he will have to wait in Serbia)?

Why does he have to leave after you get married? He can apply to change conditions from inside Canada (as far as I know). If he needs to get a visit visa to go to Canada to get married, he should list that he's visiting girlfriend. Then within the limits of his visit visa, he and girlfriend got married so he applies to extend his TRV and open work permit as a spouse. It is probably better that you wait to apply for PR after you get the answer about his TRV and open work permit. If he is refused a TRV extension and work permit for some reason, he can go back and wait for the PR.

If he is granted a visit visa to marry you, it's unlikely that he will be denied to stay with you and work. If they consider him a risk to overstay, they would not issue him the original visa to visit.

Hello Leon,

Thank you very much for your reply. The problem is, he needs to go back to Serbia after our marriage and pass the state exam in November. After that he was planning to come back to Canada.
I can't invite him to visit me now to get married cause I only have TRV status. He is planning to ask his friend to write the letter of invitation for him and to get his visitor's visa ASAP. I am wondering if it's still better for him to try to extend his TRV while he is here. Can I get it by mail if he needs to leave Canada and send it to him to Serbia after? Can he still stay there and come back before expiration? Will we be able to apply for extention once he comes to Canada even if he resided outside?
Maybe it is more reasonable not to extend TRV now, as well as not to apply for FWS, but to wait for my employment and work permit first (i am holding study permit now) and then he will apply for a new TRV as my spouse from Serbia? Will he be able to do it without the letter of invitation from me just as my spouse, or I can write it even being a TR? Will his job contract and a car be an evident proof of his coming back to Serbia for an immigration officer?

I am sorry if I sound too complicated, that's how the situation is right now :)
