Hi I was married September to a wonderful Canada man him and I also share a 2 year old daughter and I haven't yet changed my passport to my new last name and wanted to apply for PR however wasn't sure if I could being how I have really bad credit in the USA and also I have two American children which can't come with me to Canada to live because there father has them here in the USA and I now owe child support for them however I haven't been able to find work to be able to make any payments I am suppose to be paying 50 dollars a week and I am going to start paying 100 dollars a month because right now thats all I can afford being away from my husband in Canada is very costly because our bills are pretty much double right now. And once I am allowed back into Canada I have a few places that said they would hire me so at that time I will be able to make regular child support payments. I am just praying they can't hold all this against me I haven't ever went to court of non payment or anything. And I am hoping as long as I start paying something they can't hold that over me. I have had a very hard 3 years and trying to get on my feet after my first marriage went bad which is my two kids father. I can't even sleep worrying about all of this.

I also have a exclusion order from Canada which will be up in July of this year when I will be allowed to return as long as they can't hold all this against me. So as of right now I have been away from my husband for 8 months other then when he comes to visit me and my two year old child. My two year old child is a Canadian btw not sure if that helps matters any.

Oops I didn't finish my whole question also I was wondering if I could use my old passport which is still good however it uses my old last name just like my drivers is still under the only thing I have changed to my new last name is my ss card

Oh yes one more thing about my child support right now I get the kids from 6 am until 6 pm Monday through Friday and every other weekend on Wednesdays they stay the night with me so I feed them every day breakfast lunch and dinner unless they are in school then they eat at school I also buy them clothes and any thing they need so it will be hard to be paying child support payments being how the money my husband is able to send me does go to my children so they may not be able to hold me for my nonpayment not sure how all this works. and like I said before no charges have been on me for nonpayments and I have also applied for jobs after job after job and no luck they really aren't many jobs left out there :(.

It doesn't matter if you haven't changed over to your new married name, as long as the application form matches what is on the passport and other ID.

Your personal financial history is only relevant insofar as you need to show you are capable of becoming self-supporting and arrangements for your care other than reliance on social assistance have been made in Canada. If your husband is gainfully employed, along with your own work history and qualifications, you should have no issues there.

Be advised, you will need to get medicals done for your children from your previous marriage. Although your ex has primary custody, you do retain custodial rights based on what you wrote here, so you will be expected to include them as non-accompanying dependents and have their medicals done.
