I have a exclusion order for one year

HI when I was entering Canada in July from the USA they gave me a exclusion order because they believe I was planning on living in Canada without submitting the proper paper work first at the time of my exclusion order I wasn't married I was only in a common law marriage since my exclusion order on 9-21-2011 we were married with our daughter we have together she is one years old. He had to go back to Canada due to work and I am here in the USA I haven't yet submitted my application due to money issues but now I have the money just double checking my application and hoping to be home before my exclusion order says I can I'm not suppose to return Canada until July of 2012. So I'm not sure if I need to also apple for an ARC or just submit my paper work in. ANd also I was wondering how long this process could take before I am home with my husband? This whole thing has really brought a lot of hurt to our daughter and I really hope and pray I get to have her 2nd birthday with her family in Canada with me by her side as well. Being how her first birthday was spent with me in the states because I didn't want to over stay my time in Canada to begin with so I had went back to the states last year for 6 months so as you can see we have spent alot of time apart and my daughter is the one getting hurt by all this. I was going to submit a letter with my application explaining to them how this has effected my daughter but not sure if I should any help or inputs on this would be a great help

If you apply before the year is over for the exclusion order, you have to include the ARC application and the fee.

Hello punkinspice,

Just follow the normal procedure for Family Class Sponsorship if:
You have a exclusion order (not a deportation order).

The exclusion order is doubt within the context of your application.

In other words, there is no ARC needed if you follow the Family Class Sponsorship application.
TIP: Make sure when you send your application to Mississauga put a copy of your Certificate of Departure in it.

You should re-read the link. 12 months have not passed since the exclusion order. If the application is submitted before June/12 then an ARC is required.

If your read the OP post, s/he got the exclusion order on the 21st of Sept. 2011.

2. Exclusion Order (form number IMM 1214B)

a) If you were issued an Exclusion Order and

12 months have passed since you left Canada and
you have a Certificate of Departure (IMM 0056B) showing the date you left Canada

you do not need an ARC. You may return to Canada subject to normal examination at the port of entry.

b) If you wish to return to Canada less than 12 months after the Exclusion Order was issued, or do not have a Certificate of Departure, you need to apply for an ARC.

Can i make it more clear for you or what?????????????? it says NOT submit a seperate application for ARC if she goes for imigrating!
Thats in the context within the 12 months!!!!!!!! After the 12 months there is no need to put this up!

PMM, I'm sorry but you are not reading it correctly. It clearly says, you do NOT have to apply for an ARC AFTER the 12 months have passed. However, if she wants to apply BEFORE her exclusion order is up, she would need to apply the same as everyone else and it says NOT to apply for a separate ARC... that it will be dealt with within her application.

She is talking about applying now, before the 1 year expires. Once the sponsorship is approved in Mississauga, and gets to Buffalo the year won't have passed. So Buffalo will ask for an ARC. at that point. If they wait and not file the application until Aug/12, then Buffalo will receive the file after the year has past, and then no ARC would be required.

I got my exclusion order on July 8th 2011 and I was married on Sept 21st 2011 to a Canadian and we are planning a big wedding in Canadian which had to be postponed. Our family is really wanting to start planning the wedding for sometime in March not sure how good my chances are about getting home :(. Also I haven't yet changed my name on my passport its still under my old last name and it takes about 4 to 6 weeks for a name change so I wonder if I can submit my application using my old passport that has not yet expired and in the mean time apply for a new passport using my married last name. My passport that I have now is good until I believe 2019. Also should I go ahead and add additional fees to my resident application to cover the arc if needed that way there isn't any delays? I really want to get home with my husband asap because of our daughter. This whole process has really upset her and she cries for her daddy all the time. I wanted to put that in a letter with the application explaining how this has effected her but not sure if they even care about that not to be mean.

Ok I have more questions do I need to have my FBI clearance before I application for residents? I thought I could of applied for residents then applied for my FBI clearance since it takes about 16 weeks to get :(. Also do I need to go ahead and do the medical before I apply because I was really hoping I could do that once I was already in Canada not that I have anything to worry about lol. I hope someone could help me I didn't want to wait another 4 months before I apply I already waited to long as it is :(.

I am in the same situation as you (i have a exclusion order to!, mine started in march 2011 till march 2012).



Dont listen to PMM (he cant read! and he dont get it).

1* dont bother your passport, you have time!
2* Fill your application as outlanded.
3* Do the FBI check and medical (there is no negative effect).
4* Just follow the normal procedure for Family Class Sponsorship if:
You have a exclusion order (not a deportation order).

This is the fastest way to get back to your spouse!

The exclusion order is doubt within the context of your application.

In other words, there is no ARC needed if you follow the Family Class Sponsorship application.
TIP: Make sure when you send your application to Mississauga put a copy of your Certificate of Departure in it.

Should I send in my application before I do my name change I honestly completely forgot that I had to change the name on my passport and I was hoping to send in the application on Monday with my old passport and without doing the medical and FBI clearance I will do them just have to send everything off so they can start the process of the application :(.

Thanks everyone for help you have no idea how much everyone is helping me. I have since my exclusion order went into a very bad depression because I'm not just away from my husband but also because I am away from my friends and family in Canada. And being forced to raise my daughter alone even though its been only since July has been very hard on me.

One day I said we are going home and she ran to the door crying daddy and wouldn't stop I rocked her to sleep trying to hold back the tears. She isn't even 2 years old I am amazed on what a bond she has had with her father.

So I am praying I can submit the application using my old passport and maybe include a letter starting waiting on new passport with name change because the passport number will actually be that same just a different name.

I'm not sure about the passport name, perhaps someone else can answer, but I believe that you have to send in your police clearance and medical at the time you apply, or else they will send your application back for being incomplete. If they don't, you are still looking at lengthy delays, since they will have to request that information from you, which will slow your processing.

I'm am very sorry about your situation btw, I hope everything works out.
