I Follow All Minister Instructions But Embassy make own Rules

I appeal and again they reject my appeal what they written on letter here are below para.


For your information other NOC codes were not considered as they are not in the list of approved occupations according to the ministeral Instructions of November 28 2008, Should you have different or additional information, you may wish to submit a new application for Permanent Residnece in Canada.

In minister instructions clearly says if ONE NOC code match all NOC should awards the points as long as fall in skilled A O & B, I don't know embassy make own rules they should follow the minister Instructions but they are not doing that. I got 66 points but if they count all my work experience I should get 71 Now I dont know what should I do I sent them Link from CIC web site but still they not agreed. I worked so hard in my life and gain all experince but they are not giving me points. Just looking for Justice I follow all minister Instruction but Embassy Not.

I presume you had say like 3 years of NOCs from the ministerial list and one more year that is not on the ministerial list but was full time work from an NOC of skill type 0, A or B.

If I were you, I would write a letter to CIO, to the embassy again, to the minister and to CIC head office. I am not sure what else you could do.

By the way, what NOC were you in? Did you get experience letter, contract letter, etc for that NOC where they did not give you points. Is there anything missing in terms of documentation for that particular NOC?

4131 in minister list experience 23 months awards me 15 points I have five other NOC codes all with full reference letters busniess cards, everything and all fall in NOC of skill type 0, A or B total work experience almost 8 years, Embassy just saying those NOC will not count because its not in minister list. and all my work experience are geniune I really worked hard in my life. I wrote to eveyone but no one reply,
Now only God can help me and hope he will. Inshallah.

From your psot it looks like CHC did mistake. You may want to write to CIO again and explain it onece again with all the paper work

If no one listens may be a appeal in Fedral court

Embassy took already two months to response my appeal so federal time is gone and its so expensive almost 5000 canadian dollar and NO gurantee. sometime we cant do anything but I have faith and hope still alive. Lets see.

which is your visa office? I think you should keep on mailing them. i know it takes a long time but is there any other thing that you could do. i am sorry to hear this is happening to you but don't give up. Just keep on bugging them if they made the mistake.

One question from all especially Maaties That a part from 29 occupation list if you have experience from Skill 0 , A , B will the applicant experience count in points like I have

16 Months Experience in NOC 7126 Contractor and supervisor in Mechnicas Trade
30 Months Experience in NOC 1221 Adminstrative Officer
20 Months Experience in NOC 2147 Computer Network Engineer

Thats what I am goona do now but how come they refused your case becuase if you have 1 year experience in 29 Occup list and if you have experience in NOC 0, A, B you shuld be awareded point for that.See this link below.

I was in 38 list and my code was 4131 and all other code skill a o and b but embassy saying they only points award 4131 not other noc code because not in 38 list now only God can help me.

I presume at least one of 7126, 2147, 1221 is on the ministerial list. If yes and if you have conducted all these jobs in the last 10 years, then you get all the points for work experience.

See op6 cic page 39 (http://www.cic.gc.ca/english/resources/manuals/op/op06-eng.pdf)

It says

To be eligible for points, the applicant’s work experience must:
• have occurred during the 10 years immediately preceding the date of application;
• be in occupations listed in the National Occupational Classification (NOC) under Skill Type 0
or Skill Level A and B;
• not be in an occupation that has been designated by the Minister as a restricted occupation.
At the time of printing, there were no occupations designated as restricted. However, for the
most up-to-date listing, officers should refer to the Department’s website at
http://www.cic.gc.ca/english/immigrate/skilled/index.asp;
• be full-time work, which, according to R80(7), is equivalent to at least 37.5 hours of paid work
per week. Full-time work experience requirement may be met by the equivalent in part-time
paid work experience, e.g. more than one part-time job held simultaneously or one or more
part-time jobs held over the equivalent of one year of full-time work. Experience can be
calculated by adding up the number of weeks of full-time work, i.e. 37.5 hours per week in one
job or a total of at least 37.5 hours per week in more than one job, in one or more of the NOC
categories. Periods of work of less than 12 months during the 10 years immediately preceding
the date of the application may be added together and divided by 12 to calculate the number
of years


It says nothing about the work experience needing to be on the ministerial list for points.
I am sure the seniors can verify what I say too.
I believe I got points for those experience outside of the ministerial list, else I would not have made the point difference.
