Hi I am a 21 year old male looking to go back to Canada. I moved to Canada when i was 13 to a boarding school on a Student Visa. I renewed my study permit every year over and over, sometimes i would do it here in my home country and other times I would do it in Canada. I did this until 2009 when it expired, I might have overstayed my time in Canada by about three months but left to do things right. Once I got back to my home country I could not decide if I really wanted to go back so I stayed and took a whole year off school to work and focus on other things.
I recently applied, with an enrollment letter bank statements etc, to go back and got denied after a month of presenting the forms and papers at the embassy (I applied just before christmas). I have sufficient funds (I think) and I dont know why I got rejected. I do have some theories as to why i got rejected tho and Ill state them in point form:
- I have a brother, with whom i lived for about a year, who has overstayed much past his permit who currently lives in Canada, however i think he recently fixed his status.
- I was once arrested and charged, however the charges were dropped and i was never convicted.
- I did apply to college instead of a University, I could change this no problem.
- My family didn't disclose all the financial information although I did present statements with strong assets easily capable of supporting me in Canada.

I think the first two might be the most probable, although only the first one would amount to the reason given be "I am not satisfied that you are a genuine student" as to mean that there is a high chance of me staying there taking as evidence my brother's situation. However I find this improbable since I could have had that chance but didn't and not long after my permit expired I left. The second option seems to me un-canadian since I was never convicted and it has always been my point of view that if you are not proven guilty you are not guilty, therefore charges without conviction should not matter more still if the charges have been dropped.
I grew up in Canada and most of my life is there, not that it is that hard to start over at a different place but I miss Canada very much and want that second chance to grad from University badly. The nostalgia I feel to what i see as my home becomes deeper the further away Canada gets.

hello Alecaf

you were refused entry to Canada as an undergraduate

Can you state the reasons given to you in the refusal letter

This is what it says, picking and choosing from the sheet given to me.
"...You must satisfy an officer that you will meet the requirements of Part 12 of the Regulations, including satisfying the officer that you have adequate financial resources to pay tuition fees and support your stay in Canada.
Based on a careful review of the information contained in your application and all of the documentation which you have provided in support of your application, I am not satisfied that you meet the requirements of the Act and Regulations. I am therefore refusing your application."

In the back it has about 20 boxes listing possible reasons and none are checked out except for the very last ones which says "Other Reasons" right under it it says "I am not satisfied that you are a genuine student"

Also I should add. I dont know the exact reasons, but, on separate occasions, my aunt and my parents have both been denied visits. My aunt was given the reason of "I am not satisfied you will leave Canada" when she was going to my great aunts 90th birthday party, it wasn't until she brought my great aunt's birth certificate that she was given the tourist visa. My parents were just going to visit me so they got flat out rejected. A well known psychologist University professor with a Canadian brother got rejected recently too. A good friend of my mom also got rejected. All these people are well off with enough financial assets which makes me wonder what the reasons really are.

hi Alecaf

try and see whether this works

1. get someone to sponsor your education from within your family, like your parents, outside of Canada

2. add supporting documents like property, family

Can you tell me something regarding your school years in Canada and the bank statement that you demonstrated while applying this time

hey thanks a lot for the response.
I am and always have been sponsored by my parents (who live outside Canada), the bank statements and everything are my dads. I did not include property statements or anything of that sort, I could easily do that tho.
About my school years, I graduated from high-school in 2008 and I decided to go to college before attempting University were i did alright the first semester and did very poorly the second semester due to some personal problems i was having and so I decided not to enroll in the next semester. My study permit expired in August 09 and I over stayed until December 5. The bank statement is my dad's and it shows an amount capable of supporting me, with a 7 figure number.

Hello Alecaf

I'm guessing that you either obtained the modified study permit for college or maybe not and overstayed on either one of them.If you obtained the new study permit then you need to submit proof that you were studying in a college and also submit academics in regard to your first semester. If you studied in college with you high school study permit then you would have to explain to them why you overstayed.
But in both the cases you can show them your college enrollment , just to prove that you were studying

Thanks again for your help.
I did overstay with the college study permit by 3-4 months. But it was my understanding that you could stay around that amount of extra time. .
Wouldn't they have checked the "your travel history" box in the rejection letter if it had been that I overstayed. Yet the only box they checked was "other reasons" with clause saying "I am not satisfied you are a genuine student".
So leaving as the most probable cause of rejection my failure to show proof of enrollment (which, as you said, would solve both problems) do you confidently think, once I show proof of enrollment, I should technically get a study permit? When do you recommend I try again ? I should also mention I did show an acceptance letter.

hello Alecaf

I agree with you on the issue regarding the overstay matter.., if the officer hasn't checked the "immigration history" or the "past travel history" then this would have something to do with your academics, since you were already enrolled in college and didn't provide any proof regarding academics. All you need to do is re-apply with proof of your first semester academics .

Thanks a lot for your help this is truly a great website.
I'm just confused as to why they wouldn't tell me this at the embassy.
Again thanks a lot for your help you've really opened that hole at the end of the tunnel where a bunch of light now shines thru lol thanks.
