Hi all, just wanted to help a friend.
My friend is a caregiver, she has closed work permit. And this year she tried to pass an application for HCCP. But since only few are accepted by immigration her papers didn't go through. So it leaves he no options. Is it possible for her to apply for Humanitarian instead? Please give us some idea!

How is she eligible for H&C? Read the rules. She can apply next year for HCCP. Not applying in time is not a reason for H&C.
 
Aside for being a caregiver she usually volunteer here in the community as well. Its not enough reason to apply for H&C?

No. Being a volunteer doesn't prove much. How is her family and children entrenched in Canada? Does she meet H&C requirements? Why can't she return home? Not applying for HCCP in time is not a reason.

She has a sister here in Canada. The person who is applying is still single. Her permit will expire on August. I was trying to do some research about H&C too. But her consultant suggest to her to apply for that since they cant apply for HCCP this year. So she did some volunteering in the church and community here thats what her consultant told her.

She really doesn't have a H&C case and not sure if she is being given good advice. If she applies, she will need to remain in Canada without healthcare or social services. She cannot work either so will have to support herself through her own funds or money from family. H&C can take years to process.

No. H&C is to get PR. There is no work permit so she needs to plan to not work for at least 2 years or more. She stays in Canada. So she wants to have money to support herself and have funds if she needs any medical care plus daily living expenses.

She has to show why H&C is her only option for PR. As the IRCC sites states... The cost and inconvenience of returning to your home country to apply for permanent residence are not sufficient factors for H&C considerations. So she has the HCCP pathway so don't expect approval.

Well, actually H&C applicant can apply for a work permit if after an application is approved at the first stage but I agree there's no case here for H&C.

First stage could take a year, and then be refused and told to leave. Then it will difficult to ever return.

They do. But only once the H&C applicant has AIP which can often take over a year. So she would need to be prepared to remain in Canada without leaving and without the ability to work for a year or more.
 
IRCC does typically issue WPs for H&C applicants although this may be changing if the goal is to reduce temporary workers. If a applying you should show that you would be destitute if not able to work. H&C pathway will likely bebdidficorbobfhrb no
