How to visit Canada with a validity expired PR Card?

Hi,

I landed Canada with my wife and child in Nov 2003 and stayed there only for 2 weeks. We live in the U.A.E. We have not visited Canada since our landing and our PR card expired in Nov 2008. Since we have not stayed in Canada for 730 days during the last 5 years and since we live outside Canada, I presume our PR card cannot be renewed.

My child wishes to visit my sister in Canada during her school vacation. (my sister has a Canadian passport) Should my child apply for a PRTD (Permanent Resident Travel Document) or for a temporary resident visa?

Your child can apply a temporary visit visa to visit Canada.

She should go for a visit visa because a PR travel document is only for PR's who meet the residency requirements. Since she had PR status, she may have to relinquish it at the embassy before she can apply for a visit visa.

Actually CIC/CHC will probably insist that your child voluntarily relinquish her PR status, before they will issue a TRV (visitor visa) http://www.cic.gc.ca/english//resources/manuals/enf/enf23-eng.pdf Sect. 5

Voluntary Relinquishment of PR Card - Form IMM 5538B

Hi,

From the CIC website, I understand that Form number IMM 5538B (Declaration: Voluntary Relinquishment of Permanent Resident Status/Residency Obligation Not Met) has to be submitted for relinquishment of my PR card.

1) Can the form be downloaded - if so, from where?
2) How many days does it usually take to process the voluntary relinquishment request?

I can not find the form on the CIC website either. You should talk to the embassy or high commission in your country about getting the form as well as ask them how long it takes to process.

PR Relinquishment

The PR relinquishment form (available at the Canadian Embassy) was signed in front of the officer. The relinquishment was immediately effective - visa application could be submitted thereafter and the visit visa was issued immediately.
