Hi friends, I am on post graduate work permit basis in Montreal. I want to sponsor my wife who is in India right now and call her here. We are planning to get married by next year i.e. 2015.

Could anyone assist me on what visa basis should I call her here so that she can get her Work Permit immediately and do not have to wait for 6 months. Under which visa category should I file her visa?

You need to prove that you were in a common-law union for the past 12 months. Then she can apply as your common-law spouse. Summarizing, these are same conditions as an official spouse - so she should get OWP, if your NOC allows it, but you would need to prove to CIC that you were in a common-law union. To prove that, you would need to show such things as pictures, common rent, mutual bank accounts, etc (I believe, you can find examples on CIC website).

The first and foremost requirement of common law is to prove that you have been living together for the last (1 or 2) years. Please confirm the duration online. But it is one of the two. Since you have been on PGWP in Canada and she is in India, it is common sense that this is not the case. So i don't think you can do that any way.

The only possibility is to get legally married first, add a lot of proof of marriage and then apply for her SOWP.

You can find this easily on SOWP eligibility under common law.
