Hi all,
I hope I can get some help here.
The guy I am in love with has some issues going on with his status. He came to Canada on student visa. He has been studying and working. But his visa expired and he delayed extension. He was caught by CBA due to overstay and was asked to leave canada and apply again for his visa from home country. At that moment he gave up his refuge rights. But afterwards he applied for risk assessment and did not get approved. Then he appealed at federal court.
We were waiting for federal court decision to get married. He thought federal court will decide in his favor and then we can happily get married. But unfortunately federal court did not decide in his favour and have issued removal orders.
I am currently on canadian PR and my citizenship is in process. My question is if I marry him now, can I apply for
his inland sponsorship.
Please reply soon, he does not have much time.
Thanks for reading.

Sure - you can marry him and sponsor him for PR inland. However this might not stop the removal.

Note that if they remove him during the process, that the application could be found abandoned. Really the only thing you can do is try to plead with the CBSA officers before removal for an administrative deferral. To do this, they will need proof of the inland PR application. At that point, if they grant it, they will contact CIC and request the case be expedited.

If he is granted an AIP (approval in principle), then the removal order will be stayed indefinitely.

How long have you been in a relationship for? To get married and immediately sponsor him as soon as all his appeals have failed, could look very suspicious to CIC and they may suspect it's a marriage of convenience just done to keep him in the country.

Getting married after four months is incredibly fast. I think you'll find it challenging to convince CIC it's genuine given the circumstances.

How old are you?
How long have you known him before falling in love?
How did you meet?

i know 4 months is quick but this is the need of the moment. But i hv no worries as i hv no such doubts. I am 32 and well settled and also good looking. I am also doing a good job.i hv no other reason to marry him other than love. You all can understand how painful would it be to see him leave. Please if anyone knows how to fix this let me know.

regardless of whether you have worries or not, it is very likely that CIC/IRCC will. Marriage after 4 months is very quick. I'm afraid that it may be a tough road ahead.

Not to question the basis, isn't it possible that this is a cultural norm, and as such could play into the CIC/IRCC decision?

Its possible, but I think the biggest issue is marrying after a failed refugee claim.

Best bet for her would be to live w her husband for a few years in his home country and apply for sponsorship after getting lots of relationship proof

Kind of the elephant in the room, I noticed too. Not sure it was refugee, doesn't seem so. But a failed appeal for sure...

I do agree that I think this case needs the renunciation of the PR and to withdraw the application. Then spend a few years together, then apply as a Canadian citizen resettling in Canada with a foreign mate.

It may seem callus, but what other senior members are trying to say is: too many and too aggressive an attempt at gaining status in Canada will definitely attract negative attention. This is something you do not want, ever. They will tend to be more thorough and will require everything to be perfect to convince them that it's not fraud...

yeah it is the 4 months AND the deportation order together that is the killer. 4 months on its own can be overcome with lots of proof. But with the deportation order...

Alright. Its tough and four months are short. But as per profiler answer if we can convince immigration officer to grant him stay so that we can spend more time together inland then still decide to get married. Can something like this happen. I cant leave canada to live with him in another country as my job is here and also my citizenship is in process.
