How to spend least amount of time apart

Hi,

My brother lives in Germany with his common-law partner (she is German). He would like to move back to Canada but is worried about the amount of time he'd have to live apart from his partner if he applies to sponsor her (my application took 16 months). If they send the sponsorship application just before he moves back to Canada) would she then be able to apply for a working holiday visa and spend a year in Canada with him? Or would an option be to apply for the working holiday visa first, go to Canada, and then submit the sponsorship application within Canada. Is there a better alternative?

What's the max amount of time Germans can just stay for visit? Could just visit, go back/extend or some combination like that. That's basically what my hubby is doing. I go there to visit or he comes here (although its no Germany so it's easier for us). Sometimes the visits are shorter and sometimes longer (he was just here for 3 months). All I can say is thank goodness for FaceTime. I don't know what we'd do without it.

Germans can visit for 6 months at a time, but as the poster has noted it would be much better for the girlfriend to get a working holiday visa. Looking at the page it looks like its possible to stay for up to 2 years on that so would make the process pretty easy. Just apply outland while in Canada on the working holiday visa.

1. As Canadian citizen he can submit the sponsorship/application now if he wishes while residing in Germany. Just has to include an outline of what steps, he has taken as to accommodation work etc, and that he will return to Canada once she is issued a visa.

Ok, but alternatively, he could move back to Canada, wait for her to come on a working holiday visa, and then apply to sponsor? I know that he would be returning before she gets the visa, since the process can take a very long time.
Does one have advantages over the others, as far as the speed of the application goes?

Its hard to say without knowing how soon he wants to come back to Canada.

If he is fine with staying in Germany for a while longer then yes they should get the application ready now and file it with proof of intent to move back to Canada.

But if he is moving back soon, I think he may as well wait to he is back in Canada before sending off the application so that he doesn't have to worry about proving intent to move back and then actually moving back a little bit into the process.

And yes they could apply outland while living in Canada with her on a working holiday visa. So he could move back soon, file the application and she could come over on a working holiday visa whenever she was able to get it.

Yes, he is planning on moving back soon. I suppose I can check the application processing times to see if there is a significant difference between applying from Germany or in Canada.

So there are no restrictions on her applying for a working holiday visa while she has a sponsorship application in process? That is to say, it doesn't matter if she gets working holiday before or after they send the sponsorship application.

They should be applying outland either way, so it doesn't matter processing time wise if they send it off from Germany or from Canada. Although if they sent the application off while they were BOTH in Canada it could go to the Ottawa office instead of the Vienna one where there would be a difference in processing time I guess.


And no I do not believe there is, I have seen a few people on here going through spousal sponsorship while living in Canada on a working holiday visa.

They can still apply as Outland if they're here living in Canada on a working holiday visa?

Applying outland while in Canada is very common, there are a lot of people of doing it on this forum. You don't have to be outside Canada at the time you file the application, its only the inland route where it is expected you stay inside Canada during the application.
