How to prove 30 hours per week on a biweekly payroll and Stat holiday pay question

Hi Experts

I have two concerns regarding my current job, I hope someone can help me out. I work at a really small accounting firm as a staff accountant. At the time of hired, i was not given a job offer or contract to sign and just started my work. My regular hours are 32 per week, 7 hours per day from Monday to Thursday and 4 hours on Friday(actual work hours are various from 32 to 38 per week). The question is on on my biweekly pay stub, it only shows the total hours for two weeks and does not have the weekly hours break down. Do I have to prove that I meet the 30 hours weekly criteria when I apply for PR under CEC? or my pay stubs are good to go ?

My another concerns is I do not get paid on stat holiday. will this affect my PR application?

since this is a really small size accounting firm, I m worried if i will get in trouble in my PR application with the situations i mentioned above.

1. As long as your pay stubs show at least 60 hours every 2 week period you will be fine.
2. It looks like your employer is "screwing you" s/he has to pay you for statutory holidays.

Employees are eligible for the statutory holiday if they have been:

  • Employed for 30 calendar days before the statutory holiday; and
  • Have worked or earned wages on 15 of the 30 days immediately before the statutory holiday.

Thanks for answering. Yes I know I am supposed to get Stat Holiday pay, but my big concern is will this affect my CEC application???if not, I am not planing to argue with my boss for the stat holiday, because PR is my first priority.

Look, paystubs are not mandatory documents, but the letter of reference/letter of employment IS, and it must describe the hours worked per week. That is your primary proof, other documents support what is in the letter. The letter will contain salary/wage information and hours worked, so the VO can estimate your total annual earnings. If you are in Canada, your T4 and/or Notice of assessment are preferred documents; if you have those, and they match (reasonably closely) with the info in the letter, you don't even need to worry about paystubs.

Having said that, as PMM noted, as long as you have over 60 hours per bi-weekly period, it will be accepted.

This would reduce your expected income a little, so just check to make sure there's not a huge gap between what the VO would expect from the letter contents, and what your supporting documents say.

I think it wont reduce my expected income, because I almost have to stay one more extract hour every day. So my weekly hours are actually more than my regular hours of 32. As long as it will not put me into an illegal applicants for PR due to not getting paid on Stat holiday, I will be happy for now.
