How can I know if we were reported at the POE (Toronto)? The first officer said you do not meet the RO requirements and sent us to the immigration office and there I did my best to explain why we could not meet the residency requirements, due to complicated pregnancy, and I was looking after my father.

He pressed us hard with more question and I answered all of his questions, then I was told to wait for, after like 5 minutes he called us and asked can I see the baby, I lifted my son and showed him he is now different than in what’s in the picture in passport. I said yeah that's right.

We asked are we ok and are we going out? He said yes you are good to go but you should apply for renewing the PR card. He said he entered remarks on the file. I don’t know what happened

  • Are we reported?
  • Do we have to appeal?
  • Will CBSA come after us after PR expires in 2 days?

1. You would have been issued a removal order.
2. You must appeal against a removal order within 30 days.
3. No, your PR doesn't expire until revoked or renounced. Your PR card expiring does not mean you are no longer a PR. You can remain in Canada until you meet your RO to apply for a new card.

Unless you were given some papers, I dont think you were reported. So, there is nothing to appeal for.
Once you have entered the country without being reported, you are a PR in good standing. Even if your PR card has expired, it won't matter much. Just dont apply for new PR cards unless you have lived in Canada for 2 years, and you are good. Avoid all travel if possible.

As above probably advisabale to not apply to renew your PR card until you are back in compliance with the residency obligation given if you do you could start the process for your PR status to be revoked. So you need to ensure you can show a minimum 2 years residency in previous 5 years the PR card application so basically will need to stay in Canada until back in compliance.

Once you entered Canada, a note will be made in the system already by the CBSA officer.

How many days were you non-compliant on your residency obligation? Is your son born in Canada? If a removal order is issued, you can still make an appeal at the Immigration Appeal Division. Compile all the documents necessary justifying non-compliance to the residency obligation.

1) How many months extension is given usually
2) How many times we can request for an extension
3) Can he go to school
4) Can you use public health care.

Based on the information you have provided above, I suggest to get an RCIC or lawyer to work on your renewal. Since your son is on TRV, Im assuming he was not born in Canada? Therefore, you would have to go through a sponsorship process for him to get PR.

That is quite a lengthy and multi-step process and complicated one at that as you have not complied on the PR obligations.

"As of March 19, 2020 we are waiving the three-month waiting period for OHIP coverage. If you do not meet the criteria for OHIP coverage and are uninsured, the province will fund the cost of COVID-19 services."

TRV extensions depend on the Case officer.

Usually visitor status is extended six months at a time. The problem becomes that even as a 1.5-year-old, they cannot live with you permanently as a visitor. Eventually they may refuse another six month extension. Ideally you would sponsor them for PR, but you cannot do that until you are back in compliance with your RO. No province provides health coverage to visitors so you will need private insurance.

My son is 3.5 years old.
If you are in Ontario no your child does not qualify for OHIP but has coverage for anything covid related. Your child will only qualify for healthcare coverage when he/she gets PR so you’ll need to purchase emergency medical insurance and pay for routine care. No your child does not qualify for free education as a visitor although some school boards make exceptions.
