Hi My girlfriend wants to get a divorce from her ex in Philippines. She is in Alberta and I am in BC. We dont qualify for common law. It seems like it will take more time for the divorce then it will to live together for a year.
It seems to be a very complicated process to serve her ex with the papers. Has anyone had any luck and how long will this take.

Her work permit and visa expires in 3 or 4 months. Can she get a tourist visa for a year or is that impossible . She has been in canada almost two years and I am a Canadian Citizen. I can support her untill she can get OWP after sponsoring her for PR.

I think divorce laws in canada stipulate that you have to be apart officially for 1 year before being granted divorce.

If your girlfriend has already stayed in Canada apart from her ex for 1 year, she can proceed with the divorce. She doesn't need to have her ex's consent to get a divorce. Once she gets a divorce, she can legally marry you in Canada even though she is still legally married in Philippines.
