How to fill IMM1344 when Requested by processing officer

Hello,
May 2024: I moved to Canada with my daughter and was issued a 44(1) report for not meeting residency obligation

Aug 2024: I submitted sponsorship application for my daughter. The application included several forms and documents including IMM1344.
Since I was given a 44(1) report I had answered question 17 on IMM1344 with a Yes. (Are you subject of a report on inadmissibility?)

Dec 2024: my 44(1) report was "No Further Actioned" by the Minister Delegate.

Jan 2025: The sponsorship application processing officer sent me an email asking me to provide my bills, employment letter, etc. and also asking for form IMM1344.

I assume that I need to refill form IMM1344 and not just attach what I had filled in Aug 2024. As I am filling out the form IMM1344, I have two questions.

1.For the question "Are you subject of a report on inadmissibility?",
I want know whether I should answer this question as a "Yes" or a "No". Any suggestions

2. For the question "Have you submitted a previous application in respect of which a final decision has not been made for the person being sponsored and their family members?"
I want know whether I should answer this question as a "Yes" or a "No". Any suggestions

My general advice, if one is concerned that a yes or no answer could be considered incorrect because of ambiguous circumstances, is to include a letter of explanation with explicit reference to this question and explanation of the facts (and obliquely, your reasoning for answering that way).

Eg:
1. I would answer 'no' and include a letter of explanation, eg "I responded no to this question as I was issued a 44(1) report on [date] and later received a 'no further action' decision on [date] signed by the minister-delegate; it is therefore my understanding that the report is closed and I am no longer the subject of any admissibility proceedings or reports."

2. Similarly, 'yes' (or no); "I responded [y/n] to [question #/page#] as I applied in [date] and that is the current sponsorship application, that is, to which this IMM1344 pertains and which application is still open and pending."

Obviously, reprhase to fit the facts / details and your own language/style preference (perhaps not use 'pertains', sounds only vaguely human and a bit too lawyer-y, just happens to be the way I speak).

One more question:
Along with this form, they have also asked to List Absences from Canada: For the last five years or since obtaining permanent resident status in Canada (whichever period is shorter), provide a list of all absences from Canada (including all dates of departure as well as return dates to Canada)

Since I do not meet the residency obligations, I am wondering whether I need to explain my absences too. OR do I just list the dates when I was absent from Canada ??

Context: I have already provided a 100 page detailed explanation of my absences from Canada when I applied for my PR card renewal couple months ago. That application is still pending.
