How to apply for Open Workpermit?

Hello everyone,

I checked this forum to find an answer for my question but I can't really figure my situation out.

I am from Germany and currently residing IN Canada with an extended Visitor VISA.
I am married to a Canadian citizen and just submitted my PR application in the Family class.

After I extended my Visitor VISA I got to know that I could also apply for an Open workpermit, is that right?
If yes, where can I find the application forms?

A senior member can correct me if I'm wrong, but at this point you cannot apply for an OWP until you have passed the first stage of the process.

You can apply once your sponsor has been approved.

You can only apply for a work permit from inside Canada if you:

* are currently in Canada and have a valid study or work permit, or your spouse or parents have a study or work permit,
have graduated from a program at a
* Canadian university,
* community college,
* CÉGEP,
* publicly funded trade/technical school or
* other eligible school,
* have a temporary resident permit that is valid for six months or more, or
* are in Canada because you have already applied for permanent residence from inside Canada (you will have to pass certain stages in the main application process to be eligible for a work permit).
When you have gained first stage approval (SA) you can apply online for an OWP, here:

but as your quote says, the second point, I do have temporary resident permit (Visitor VISA) which is right now valid for more than six months.

Would that mean I can apply for it?

A temporary residence permit and a visitor visa are not the same thing. You have a visa, so you are not eligible to apply for an OWP (yet). If you applied inland, then you are eligible for one after you get AIP, which takes about 8-12 months (I don't know the current timeline).

SA is not used for an Inland applicant. SA is merely `Sponsor Approval', whereas an Inland applicant receives AIP (Approval In Principle) which is sponsor approval and the relationship assessment combined.

The question seems to be if the OP could have submitted an Open Work Permit (OWP) with the Inland application to give her implied status. The answer would have been yes. Even though she would not have been eligible until she has AIP, she was authorized to submit it with the Inland application.

I have no idea if an OWP can be sent now, to offer the same implied status (once her current status expires).

The form is IMM5710 and the fee is $155

Better to call CIC and inquire...then hope that you get a correct answer!
