How long one can work from India on Canadian work permit?

Hi all,

I have a Canadian PGWP and a full time job in Canada. I came to India four months back and have been working from here since then.

My question is, how long one can work from India on their Canadian work permit? If we work from India more than 4 months, Will there be any issues at immigration while returning?

You never have to return but your working in India for a Canadian company doesn’t count as Canadian experience. You must be IN Canada to count your experience as Canadian.

Assume your employer is aware that you’ve working from India. Not issue but if you work 6. months or more it becomes an issue for both the employer and potentially for you. Has to do with residency, how you get paid, benefits, etc. You need to review residency rules to retain healthcare coverage for your province especially if you only recently qualified for provincial health coverage. A valid card doesn’t mean you have coverage which is confusing. You still need to meet the residency requirements.

Thank you @canuck78 for the reply. My employer knows that I was in India only for a month and he is not aware of about my extra three months of stay. However, I am planning to leave for Canada on next month. Do I face any issues at immigration or for PR application because of this?
There won't be any issues with immigration. For PR, you must make sure you do not count these four months as Canadian work experience.

It can be quite dangerous to hide something like this from an employer. This can be a code of conduct violation.

Yeah, it is dangerous to hide it from employer. I didn't have any choice as I have to fix some issues here and I don't wanna lose my job at the same time. Anyway, I will be leaving India soon.

As already indicated it is an extremely bad idea that you hid this from your employer. Do you receive any form of benefits from Canada? Like child benefit? It is extremely important that you not stay for 6+ months because that has major implications on how your employer would pay you and you would be required to tell them that you were away so they don’t submit fraudulent payroll information. As you are now talking about 5 months of being away you may no longer qualify for healthcare in your province and have to reapply.

I don't receive any benefits from Canada. As of now it's been 3 months since I am staying in India. Out of these 3 months, I was having one month of vacation but still my pay roll ran for 3 months. I mentioned 4 months because by the time I leave India it would be 4 or 5 months. However, I am planning to leave on next month which will be total 4 months. Do I lose my healthcare for staying away for 4 months? Does it affect my PR application?

You have to look at your provincial health insurance residency requirements and when you initially applied for provincial health insurance. If you don’t meet the requirements you have to reapply. As long as you qualify to apply for PR being outside Canada doesn’t impact PR applications but work while outside Canada won’t count towards working in Canada.
