My relative is a TFW and he expired his work permit this 7th of March but filed an extension yet was refused this 9th of May. He said he is automatically in a restoration status? He said he has an application as Temporary Resident but the immigration did not accept it for he is not eligible due to his expiring passport this June 13. He cant seem to renew it there for authentic documents from his country will process for 4-8 weeks. I'm afraid he may reach the 90-day period without passing any application. Is he really automatically on a restoration? Is he eligible for this restoration status though he doesnt have any pending application?

Nothing is automatic. He's currently out of status in Canada. He has 90 days from the time he was refused to apply for restoration.

If he passes the 90 day window then it will be too late to restore his status from inside of Canada and he will have to leave Canada.

Same post different answer http://www.canadavisa.com/canada-immigration-discussion-board/how-does-restoration-status-really-works-t415911.0.html

The sticking point likely passport expires June 13th so even with restoration there is no valid passport likely to be in effect.

Thank you, you mean to say that his Restoration Status is ineligible because of his passport? He has no plans of applying for restoration. How can I report that?
