Hi,

I hope someone can help me...

My app for pr is in Vienna right now, i am being sponsored by my husband, outside of Canada.
The fact is that all my trust for him is totally, completely gone, I am afraid to move to him and be depended on him. So i want to get divorced ASAP.
I already wrote Vienna an email telling that I've given up my intension to immigrate and I am staying here in home country.

My question is how can/shall I do it, if I want to apply for divorce?

Here are the facts:

I am a Hungarian citizen, living in home country.
He is a Canadian citizen.
I've been in Ca 2013 April 30- May 21. We haven't met since that, so we are apart for almost a year now.
We got married May 11th 2013, B.C.
Our marriage is not recognized in Hungary, I haven't done it yet, I was planning to do it in Canada, At the Hungarian Embassy after landing.
We never lived together.
We got no financial things in common, no bank account etc. nothing. No children in common.
I got proof of cheating.
I don't want anything from him in the future , except the divorce.

If you divorce your husband, or get divorced by him, you will not be able to apply for permanent residency under the family class, your application will fail and there will be no point in proceeding with it. You may be able to apply for PR under some other category but I cannot help you with that: my only experience is with the family class. Some other qualified member of this forum may step in to give you advice about that. Even if you were not divorced it seems to me that your application is weak, given the facts you describe and the eventual outcome of your application may well be the same, divorce or no divorce. As for a divorce, you need to consult a lawyer in Hungary. I have not before come across the concept of a marriage celebrated in Canada but 'not recognized' in another country. Normally marriage confers a status and I have never come across a case of a marriage being invalid until it has been registered at an embassy and do not at present believe that that can be the case. You should ask your Hungarian lawyer about it.

I would also add, regardless of the "misrepresentation" aspect of continuing with the application if you separate or divorce, that you would almost certainly be given a "conditional PR", based on the length of marriage and the fact that you have no children in common.

Therefore, you would be bound to living together as a married couple for two years after becoming a PR or have your PR status revoked. I suspect that you would find such a situation untenable, so you should probably abandon any attempt at immigration via the Family Class sponsorship route.

OP is no longer interested in coming to Canada and obtaining PR (see her most recent posts). She's just looking for guidance on how to get the divorce finalized.

Scylla is right, I do NOT want to go to Canada in this case, what would be the point? I am not the person looking for benefits of Canada, especially not by false marriage. I am staying in home country.

I just simply want to get divorced, and becsuse I never got it registered here in Hungary, "I am only married in CA" if you know what I mean.

Because you are a not a resident AND your marriage is not recognised in your home country, you will need to apply under the the Civil Marriage Act.
