How and where to submit an ARC?

Hi,

My wife is in Guyana and need to submit an TRV/ARC application.

The application is ready, in "paper form", but the local Visa Application Centre is not accepting paper applications because of covid. Going through the Visa Application Centre's website (vfsglobal) I end up at the Canada IRCC website to "Apply Online". So we made an account and went through the choices for a visitor, but there doesn't seem be a way to "apply for an ARC". And I don't know what to do for the payment choice as we have made the $400 payment already and was going to include the receipt. And the total after all the choices made, comes to $185 (a common visitor visa + biometric).

Now, can the ARC application be sent directly to the Regional Visa Office (Port of Spain) (assuming they are taking paper applications), is that how it is supposed to done normally (sent directly to regional office)? I'm just kind of beginning to understand the difference between Visa Office and Application Centre.

Or, do we submit everything online as a common visitor visa pay the $185 and wait for their request of an ARC fee? And just refund the $400 we already paid.

Sorry, but the whole immigration process is just a bit daunting to me. Right now the only thing standing in the way of my wife reuniting with us and be able to finalize her H&C in Canada is a TRV/ARC.

Now I found the following paragraph from the IRCC website some time ago, and found it again now:

"If you are applying to come to Canada for any reason, (visiting, studying, working or immigrating), you should not submit a separate application for an ARC. If your application is approved, the ARC will be dealt within the context of that application. You will simply be asked to submit the fee."

If high school English is as good as I think it is, it is saying "Apply for whatever you need normally, then if your application is approved and if you also need an ARC, we will ask for an additional ARC fee and then we will deal with it"

That's what it is saying right?

Because this whole time I just felt like getting an ARC is this big special process...

I think the thing that confused me was that in the beginning I thought the ARC would be dealt with during the H&C process. But that's not the case, and I guess it makes sense because an H&C is really asking the government if you can stay in Canada and since you are (supposedly) already in Canada there would not be a reason to need an ARC.

So I guess the only thing to do now is apply online. I hope I'm right about this.

Hi,

Here is basically what happened:

1. She submitted her H&C application while she was still in Canada. But The CBSA was preparing for her removal at the time.
2. We basically submitted the H&C application way too late for her to be allowed to stay for the decision. The CBSA felt it would be too long a wait for the decision on her application.
3. Through a lawyer submitted a something to delay the removal. It was denied.
4. The issue was brought to the courts. It was denied. Mainly because she had misrepresented and did not address all of that in the submission.
5. Wife left Canada.
6. H&C stage 1 approved, then she submitted all the required documents.
7. Submitted an application for a Visa and Arc. Back in mid April 2021. Still processing.

She cannot finished the H&C application until she comes back.

Hopefully it's just the effects of the pandemic delaying the processing time and not something else. But according to other posts on here from a few years back. An Arc can take a month to a year or more depending on the case.

My family and I were deported 1 year ago. Now we received Aip, but they didnt ask us to submit arc. Shoul I wait them to ask for it, or I can submit right now with the letter of aip?. Did they ask your wife to submit arc after aip? Thanks for your answer.

I don't know what an AIP is but any time you are "deported" you will need an Arc. They did not give us any instructions as to what to do --- No Instructions ---. "Once you are out of the country, you are on your own, they will not "ask" you to come back." That is very clear to me now.

We were kind of waiting for "something" after the H&C stage 1 approval letter but it seemed that the approval letter was what we would include in the Arc. My lawyer later contacted the Immigration department and they just simply said my wife need to apply for an Arc.

For you, it's best not to wait like we did. I still feel pretty dumb for waiting. Best to email the Immigration department for what to do next if you are not sure.

That's exactly what confused us. So we waited for them to ask us for the Arc fee. Which never happened.

It depends on the application. That apparently does not apply to our case. I think it is meant for anything that was applied while outside of Canada. In our case. My wife's H&C was applied inside of Canada as it is supposed to be. But she was deported, so now she is applying for a visiting visa and the Arc will be dealt with in that application.

At least that's I understand it.

And in the visa application, we state very clearly that one of the purpose of her visit is to complete her H&C application process.

Hi, no news. Stuck at "Background Check" process. From reading other posts here, the processing time can be quite long, even before the pandemic.
Hi my friend any news? Yesterday I received an email asking for fees, even when I already submit it with other documents. Hope it will finish soon.

Paper work sent to immigration still waiting for arc..

Hi everyone

I am looking for information about ARC application. Infact, I was given Departure order but I didn't comply within 30 days rather filed an appeal before IAD which was also dismissed thereafter I filed Judicial Review and the same was also dismissed. Then I left Canada without informing Immigration Department. Now I want to come back to Canada to attend wedding ceremony of my nephew.
Should I file an application for visit visa only or I have to file an application for ARC alongside visit visa application.
Your comments will be highly appreciated.
