I have a friend who got permanent residency card as skilled worker in 2001. But he did not stay long enough in Canada since he was still developing his early career back in the US. As result, he did not meet the residency obligation and his PR card has expired.

Now, he is seriously considering applying for skilled worker again. But since he did not meet the residency obligation last time, he worried that whether this will cause some concern for the immigration officer so that his new application will be refused?

Could any of you give some advice? Whether his new application will be negatively impacted? Will his applilcation still have chance to be accepted? Thanks!

Sure he can reapply, but before the visa office will accept a new application, he will have to voluntarily give up his previous PR status. Yes I know he has failed to meet the PR obligations, but CHC insists on giving up the previous status. See: http://www.cic.gc.ca/english/resources/manuals/op/op10e.pdf Section 10

Thank you very much for your information! So if he strictly follows this procedure you outlined, do you think his new application will still be negatively affected by his lost of previous PR status?

They may question his motivation, if it is really his desire to settle in Canada.
