Need a quick clarification for a friend who is a Canadian Citizen, looking to get married in India, to an Indian, Hindu girl - he wants to marry under the Hindu Marriage Act (HMA), which he can do under 'Tatkal', whereas he's said he has to do under the Special Marriage Act (as he's a Canadian Citizen, even though he is a Hindu), which needs a 30day notice. Can anyone clarify if he can marry under the HMA (as it's difficult for him to wait the 30day period, in India) and that HMA certificate will be valid, while he submits the Spousal Sponsorship? Appreciate any input, thanks

Hi

First thing

Hindu marriage act is for 2 people who are only hindu and want to get married to hindu only ,

Special Marraige act is for 2 people in which both of them belongs to seperate caste or religion or culture, that means it's for interfaith mairrage ,

Those mairrrage act has nothing to do with nationality

If canadian citizen is Christian or Muslim or Sikh or Punjabi and the girl is hindu , then ya you should go for special marriage act

If canadian citizen is hindu and girl is hindu then they have to go for hindu marriage act

Because they both are from hindu culture so they have to go for hindu mairraige act

Obviously mairrage through hindu mairrage act is valid as they will have legal mairrage certificate and there maiirage will be registered

U can file sponsorship with that certificate
