i was told by my representative that our application has high chance of refusal.
and that we are going to take the risk if we still want to pursue the STUDENT VISA APPLICATION...

please help... i need some advice here. me and my partner can't decide...

my common law partner has just received his appointment letter / offer letter from VANCOUVER INSTITUTE OF PROFESSIONAL MANAGEMENT
for a 2 year course in POST DIPLOMA IN HEALTH CARE MANAGEMENT.
this morning, our representative called up and said they are already ready to lodge our papers in the canadian embassy.
And we are requested to pay the tuition fee in that school.

We are hoping so much that I can join my partner with a DEPENDENT VISA.
they notified us earlier that if i get approved with the DEPENDENT VISA - i wont be able to work or have any position in a company. instead, it will only be my partner who can work for us.
the thing is, im 5 MONTHS PREGNANT NOW, AND 4MONTHS FROM NOW I'LL BE GIVING BIRTH TO OUR FIRST CHILD.

We have enough funds, credible documents, and properties under our name.
But we are a bit discouraged because agency said, we have less hope for this because we might be questioned of our intention in moving to canada... i don't want to be separated with my common law partner... especially that i'm pregnant, if we go there, i have a lot of relatives who can support us in our needs.

DO WE HAVE TO TAKE THE RISK? IS THERE REALLY A GREAT CHANCE OF REJECTION? OR IS THERE ANY HOPE TO THIS APPLICATION?
We really need an expert advice on this... by the way, the school has also offered a WORK to my common law partner... PART TIME 20HOURS/WEEK for first 6months then 40HRS/WEEK for next remaining months of his stay there.

i appreciate if you can share your ideas. thank you so much...

hello kyle, i think we have the same situation, i was called by our agency from ortigas that the our application has not 100 percent chance of getting visa , also Im planning to apply my husband with me but our agency said that there is no chance of getting a job for the dependents. and they advice to us is try other school in Manitoba, but after i search and read some of there program, the tuition fee is much higher than VIPM and i have to pay all the tuition fee before i will given a acceptance letter from the school.

It is very hard to decide, im also thinking of backing out because of our agency promise us that there will be no problem in getting our visa but after we decide to sign up and chose VIPM and while completing our requirements and also i have schedule for ielts exam we are surprised about the changes.

because a lot of money is involve here, i want to make sure our application is good steps, i dont want to be denied at the end of this.

we have paid almost everything. and we are about to pay the tuition fee by monday already...
i have been trusting the agency. i know we have the same offer.

2 weeks ago they said i can work, but i think they were told that dependents can't work.
this time i guess there's no turning back. we received an OFFER LETTER/ACCEPTANCE LETTER from VIPM already.
Red river in Manitoba is not an option for us, because our relatives are all in vancouver.

What do you think is the best thing to do jen?
we informed them to take the risk... to go on with the application with me as the dependent...
we are hoping for the best. i will be there in the office tomorrow to talk to atty for some advice or options...

1. You know that you can't work off campus with a study permit from VIPM and you won't get a PGWP either.

Hey, to the best of my knowlegde I think the institution/university you apply to can determine whether you get a pgwp or not. You have to go to the CIC website to see what colleges and universities you have to study at/graduate from to be eligible for off campus work permit and pgwp. Hope this helps x

Unfortunately I am on my phone and do not know how to copy the link for you. But try and search for off campus work permit on the cic website somewhere in the conditions it has a link to eligible or participating institutions or something like that. Just click on it and you will see a list of colleges and Unis for each province

Congrats for your coming baby!

You really aren't alone... i m on the same situation. I submitted my application without my wife and daughter's TRV. I was told by everyone, despite our adequate funds, we all would be refused because of "family tie" issue.

Now I feel so sad to think of living apart from my family, I seriously think we should apply altogether so that if we are refused, it would be a decision for all. Moreover no one can guarantee that spouse/ dependent will get visa afterwards.

I would suggest you to apply altogether so that the decision is made once with no future uncertainty.

As far as i know, PMM is right, you can't legally work off campus with a study permit. And PGWP does not depend on school, its for any PG course. The length of the permit depends on the length of the course.

One more thing I want to tell you, my personal opinion, never trust agencies, most of the time they wont tell you true facts, they will only tell you hard facts when you are into the middle of the sea and can't escape.

kyle i think the reason that our agency said that our application is not 100% visa chances is not to blame them in the end, but in my opinion they given as in the 1st place an assurance of having a work permit in our dependents, actually i sign up to them because of having my husband a visa also a work permit. they give us a false assurance!

They should tell us every thing before we sign up with them, so that we know our situations properly.

I'm planning to talk to atty this week and ask what is our option, and the real scenario so that we are not being surprise and not to be worry, a lot of money is involve they should be very specific and accurate, our time will be waste and also other good plans that we let go because of them.

Please kyle update me after you talk to atty. im planning to visit our agency by thursday.

i'm seeing light now in the decision we will take.

i have seen flaws from the previously discussed "FALSE REASSURANCE"... i think it was a mistake though that i haven't been receiving first-hand information directly from the resident immigrant attorney we have in our agency. i have been communicating consistently with the assistant (not an attorney), hoping so much that we can make it through all this, but it seems things are getting on the wrong path.

first thing, she said main applicant can bring dependent through TRV, and that dependent can work full time... BUT, took it back and says dependent can't work, and dependent can't join the application...

second, she said main applicant can work part time for the FIRST 6MONTHS 20HOURS/WEEK then work full time for the remaining months until the 24th month (2 year course) for 40HRS/WEEK... cic website says otherwise... http://www.cic.gc.ca/english/study/work-offcampus.asp

"To work off campus, you must apply for a work permit. Do not begin to work off campus until you have received your work permit. The work permit authorizes you to work up to 20 hours per week during regular academic sessions, and full time during scheduled breaks (for example, winter and summer holidays, and spring break)."

third, she said VIPM can offer an off-campus work for the main applicant. but upon checking the list... VIPM is not a part of the approved post-secondary institutions and haven't signed an off-campus agreement. http://www.cic.gc.ca/english/study/institutions/participants.asp

another answered question: CAN MAIN APPLICANT WORK IMMEDIATELY UPON LANDING IN CANADA. she said they will be given a job offer upon arrival. cic website says... http://www.cic.gc.ca/english/information/faq/study/index.asp

"No, you cannot apply for a study permit and an off-campus work permit at the same time. To qualify for the program, you must already hold a valid study permit, and you must have been a full-time student at a participating institution for at least six of the last 12 months before you apply."

this one BREAKS MY HEART... how could they hide this fact...

jen, i don't think the assistant can help me with my personal questions. i will ask if i can have an appointment with attorney... and directly will ask for answers clearing all this assurance previously told. i have paid half of the service fee im supposed to pay for FSW... i think this time im not going to continue this student permit already. it seems really RISKY AND UNCERTAIN... i guess i have to wait for the FSW instead. i'll keep you posted...

btw, are there anyone else who have the same case as ours? or are there anyne who have successful stories of getting their dependents during the student permit?

kyle it is very risky to continue, because they are not consistent, Im also fsw applicant before, I try the student visa for another option but i think is it not safe enough to continue. May be will wait also for the fsw to open for migration option.

There assistant was not to blame because of what ever there assistant is saying to there applicants are coming from the agency, i think the atty from agency will say to you that the fault is from there assistant and they didn't know what is doing but it is just only there alibi. When i ask the person who handle my application they said to me that she was gone, and will transfer my handler to atty. I don't know why but i think for them to clear there faults.
