Dear All,

I took a PR card with my family in July 2008 and returned back for home country , My wife and My boys do not like to return with me , if I retrurn to canada alone next July 2011 and stay 3 years to fill the requirments of citizinshipe, Can My boys 14 and 12 years ( after 3 years they will be 17 and 15 years) take the citizenshipe as their father will be canadian..

If you landed in July 2008 and are not planning to return until July 2011, you must be very careful with the dates. Once you are outside Canada for 1095 days, they can revoke your PR. If you are close with the dates, that also means that you can not leave Canada for the next 2 years after you return, not even for visits.

As you return to Canada after 3 years away and your family does not, they will lose their PR. You could however sponsor them again. Say you return to Canada in July 2011, you wait until July 2012 and then start sponsorship of your sons. Your sons would get their PR again and have to land again probably between January 2013 and July 2013 depending on where you are applying etc. By the time you apply for citizenship, in July 2014, they will only have been PR for 1-1.5 years and will not have lost their PR again even if they had not moved to Canada so in that case, you could include them in your citizenship application. They will not have to take the test but they will have to appear for the oath ceremony.

However, why apply for citizenship if your family does not want to live in Canada? Would you not be better off staying with them where they have chosen to live?
