I am a Canadian citizen. I am sponsoring my husband from USA. He just got back his criminal record checked. It states that he got charged (for threatening a bus driver and the bus driver complained to the cops) just OVER 10 years ago. Another point to note is that he was 17 at that time. Since it has been just over 10 years ago and he was under 18, would that cause problems with him getting a permanent residence in Canada. Please help!

My partner pulled a college prank 14 years ago, and was charged with a felony which was then dropped to a misdemeanor. Court documents from the state of Minnesota show the dropped charge, but his FBI cert still shows a felony. Our immigration consultant said as long as we had court documents and it was over 10 years ago it would be fine, he's "rehabilitated".

As well, when crossing the border in January, the border patrols did pull this up and questioned him about it, but then as soon as they saw it was over 10 years ago, they also let it drop. The official actually said, "Oh, you're right... okay, never mind."

I personally, don't think it should be a problem, but.... we are also still waiting. Just my two cents to ease nerves. I think as long as you have all documentation... it's good.

Your husband can try crossing the border into Canada, and chances are if he suceeds, then he is ok for immigration to Canada.
