Hi Everyone,

I am currently sponsoring my American husband to come to Canada. We applied outside of Canada. On top of our sponsorship application we have to do a rehabilitation application. My lawyers are frustrating me right now. My husband has a misdemeanor and he is inadmissible to Canada so the lawyer says. Yet he has visited twice now and has had absolutely no issues crossing the boarder. So is he inadmissible or not? He has been here for 5 months now and next month is the 6 month marker. We are waiting on his FBI check to come back before the lawyer can send away our application. The lawyer said he has to leave the country before we can send the application away because he is inadmissible to Canada. Is this true or not? I feel like he is using his misdemeanor as a crutch and a excuse for everything!!!!! I want to get apply for a 6 month extension which the lawyer says we cannot due to his inadmissibility. I am truly frustrated I am paying this firm to work for me and it feels like they just want my money.

I could use and help or advice I can get.

Just because he's been allowed into Canada doesn't mean he's not inadmissible.

We need more info to help you. What was the misdemeanor? When did it happen? What penalty / fine was he given and when did he complete that penalty / fine?

He lied to a cop. Was arrested that day and paid a fine and that was it. The cops let him go. There was no penalty. I believe they must have had a judge in the police station or something. It was almost 8 years ago. He cannot have it expunged he had a felony expunged within the last year or 2. He made some dumb choices when he was young. The incident happened when he was 18.
