Hello
Im planning to sponosr my soon to be wife and every time i call the government of canada i get two different answers. They keep telling me to use the check list IMM 5491 and the next time i call them somebody else tells me to use IMM 5443.

Can anybody tell me which check list to use. I just want to make sure i fill out the right form before sending it in.

thanks

One is for inland and one is for outland. Those are the two ways to apply, and its up to you which one you choose. In most cases, applying outland is much quicker than inland, and you have a right to appeal with outland, and not for inland. I'll give you the links to each page so you can read it over and find out which application is best for you. The applicant can stay in Canada for either application, as long as (s)he is legal.

outland: http://www.cic.gc.ca/english/information/applications/fc.asp

inland: http://www.cic.gc.ca/english/information/applications/spouse.asp

Generally, for inland applications, they go to Vegreville, AB where they are processed, and they might be sent to a local office in your area in Canada for further completion.
For outland applications, they initially get sent to Mississauga, ON, where the sponsorship is processed, and then they get sent to your home country for the completion of the process.
Again, for most cases, outland applications are processed faster overseas than inland ones are processed in Vegreville. So my suggestion is outland, but its your call.

Your inbox was full, so I replied here:

yes, she has to fill out form 5490 as part of the application.

The application is three parts, as described here:
http://www.cic.gc.ca/english/information/applications/fc.asp

You have to complete all three parts. For the region specific forms, you need to find the applicable forms for the country she is from, and fill out those forms.

Unless she has a work permit, she is not allowed to work in Canada until PR. Also, unless she has a study permit, she cannot take classes in Canada until she gets PR.

Your previous question about living exclusively outside Canada, question 20...did I answer the right question for you?
