Hello,

I am eligible for CEC and got an ITA but last year after I finished the requirements of the study program, I worked PT for three months before applying for a PGWP.

All this while I had a valid study permit but had finished my semesters and technically was no longer a full-time student. Honestly I didn't know this new rule then and thought after 6 months one can work off campus on a study permit.

Today I came across the study permit rules: "You must stop working on the day you no longer meet the above eligibility requirements (e.g., if you are no longer a full-time student during an academic session.)" http://www.cic.gc.ca/english/study/work-offcampus.asp

Will they take action??

What should I do? Should I delete this work from my experience on the EE profile? Or let it be since it is over a year old?

The above work is all with my current employer.

Any advise?

Unfortunately the way that a VO is likely to interpret this is that you were working after your 'student' status was effectively over.

This work experience must be listed in your personal history but unfortunately you will not be able to claim the points for it. The point at which the work experience begins for EE purposes is after you received your PGWP. Do you have more than 1 years work experience after receiving your PGWP?

I do not want to claim the points for the 3 months I worked PT, but the system automatically gives them to me cause I do not check the box "were you a full-time student during this job" which I wasn't.

I'm just worried if I do mention this work experience then they shouldn't say I was working after I was a full time student, and take action here based on the new rules.

However, I do have 1 year work exp, taking into account the 1 month waiting for a PGWP.

New rules do mention "Eligible international graduates will be authorized to work full-time after their studies are completed until a decision is made on their application for a Post-Graduation Work Permit"

The thing is as this work is all with your current employer, you have to mention it in your EE profile. As you started working for this employer before receiving your PGWP and after completing your studies you have to input the correct start date. To not mention it, and if the VO catches it later on, you would be deemed to be 'misrepresenting yourself'. The way they would possibly catch it is if they ever want to match your T4 to the information reported in your Tax Return to Revenue Canada. From what I understand when processing immigration applications all these government departments can communicate with each other to verify information.

The reference letter that the employer gives you will have to mention the correct start date and if the employer does not do this they could get in trouble.

What I suggest (if it can be done) is to write a LOE informing CIC that yes you did work after completing your studies but before receiving your PGWP, and you have more than 1 year of work experience after receiving your PGWP.
