My name is Martin, I live in Argentina, and I am highly interested in migrating to Canada.
I need your help to understand what is my marital status for Canada, as I need to complete the forms, I am afraid to do it incorrectly and be banned for "not telling the truth".
Let me explain my situation, as I think is complex at least for me. I was in relationship with another man from 2003 to 2009. In 2007 we visited Canada and got married there during our vacation, and then returned to Argentina. We never lived in Canada. Then in 2009 we separated. In Argentina same sex marriages were not allowed at that time, so we never got married here in Argentina. We never registered the marriage in Argentina, so for Argentina law I am still single. I only have a marriage certificate I got from Ontario.
Since 2009 we are separated, not living together, and couldn't find a way yet to request the divorce in Canada, as I am living in Argentina.
So the question now is, how should I complete the forms? For Canada, am I single or married? Am I separated? I don't have any paper for that. So every time I have to complete the form, I have no clue how to complete. In addition, he has a son who now is 24 years old. Should I put his information too in the form?
Today I am in a new relationship, living together with another man since 2010, but we don't have any legal status. We are both looking to migrate to Canada, and again we don't know if we have to apply separately or I can include him on my form.
