hey guys,

my time line is :

ita- dec22,2016
aor- feb 6,2017

my work permit is till june 20.2017 and temp visa is expiring the same day.

so right now i m in toronto n m planning to go to india for 2-3 months since i have received the AOR. somy ques are:::


1- is it good to go during this time?

2- i will come before june20 ( since my w.p expires then) so will the canada immigration allow me to enter or they might create issue regarding very short work permit left?

3- should i apply for BOWP from canada before i go to india or it can be done from there and if i do apply it from here then it will be mailed here and i wont have any proof when i land back.....m confused

4- lets say i am in india and i get PPR then whats the process?



i will really appreciate any senior member or any experienced answering all the ques in order.

I am not so sure about all your questions. But my 2 cents for your question 3 & 4

3. You must be in Canada while applying for BOWP.

4. If you are in India when you receive PPR, you can mail your passport to Canada or request for stamping in New Delhi.

Here is my two cents on your first questions:

1. I would not recommend it, of course there is nothing wrong with it, but you will have a 3 months holiday gap in your history once you want to apply for your passport. And that would not look very professional. Again there is nothing wrong with you taking some months off. Personally I will stick around in Canada till I get my hands on the PR card.

2. They will have to allow you in, you still lawfully have re-entry visa to Canada, bare in mind study permit is something and re-entry visa is something else, so you might want to check up on that. But don't arrive a day before your visa expires, the officers will have to question you on this! Put yourself in their shoes, Are going to stay in Canada for only one day or couple of days? What is the deal here? Again I would recommend that you stay.

4. Just to add a bit of info, you have to change your address on your file when you are not staying at your current address, it's best if you change your address once you get to India. You can have your passport stamped in India. Hassle free.

It is absolutlely OK to leave for a time (I disagree with rezefc about this, I see nothing unprofessional about it). I gather you do not have a job at the moment, so why not?

However, if you want to be able to return and apply for the BOWP, I would suggest not staying away too long - two months max.

also disagree with rezafc on this - IRCC can refuse entry regardless of the permit, if they have any reason to suspect you will not maintain status or leave before the end of your permit. (It is unlikely but possible). That is why I suggest that you return well before the expiry of your permit. Since you can't apply for the BOWP outside Canada.

Also note that if you apply for your BOWP and your old permit expires before you receive the BOWP, you will be on implied status, and you cannot leave Canada during implied status (well, you can leave of course, but you lose implied status then, and won't be able to work until you receive the BOWP).

You must be living in Canada to be eligible for the BOWP. I would not advise applying from outside, or traveling while it is being processed.

You can come back and submit your passport to Ottawa, or you can request stamping at the VO in New Delhi, and you would "land" when you arrive back in Canada.

BTW - the option exists to mail your passport to Ottawa, except for holders of passports from India - that is India's law, though, not IRCC's.
