Hello,

My wife's case is somewhat complicated than others.
  • While waiting for PR, my wife's previous VR expired on Nov3,2012. Before the it's expired, she applied for another one.
  • On Nov.17,2012, her mom passed away. She took an emergency flight back to India on Nov.17,2012. .
  • On Feb.18, I recieved the new VR and send it back to her by express. .
  • She applied for US Visitor visa on Feb.25 and got it in a week.

I planned to let her travel to Buffalo and drive there to take her back. After reading the posts about the validity of VR, I am not sure if she will be able to enter Canada.

CBSA doesn't have call center, I don't know if CIC can answer my question.

Any help is higly appreciated.

Sincerely,
J

VR does say not authorized for re-entry but read this

http://www.roadtocanada.com/forums/showthread.php?tid=6430

However issue here is that she didn't exit from Canada to US but Canada to India and then US to Canada

Complicated for sure

Thanks for your reply. I am checking all post I searched and will call CIC tmr.

I am reading the Guide 5551 (I am not allowed to post links). In the section of re-enter Canada, the first bullet says
you are returning to Canada following a visit only to the United States or St-Pierre and Miquelon; and
The word following scares me because I think it means go to US from Canada and back to Canada from US. Now I feel I am questioning my English.

Read here too - http://www.canadavisa.com/canada-immigration-discussion-board/can-i-re-enter-canada-on-a-temp-resident-permit-t35518.0.html

It seems it's forgiving if she goes from Canada to US and back but the case is different here. She will enter via US but not sure if CBSA will be able to determine if she actually left Canada for India then came to US and then re-entering.

Ask user "PMM" he is resident expert, PM him and he might give you the perfect answer

EDIT: Looks like its correct

Also if you were granted a Visitor Record then you can use that to re enter Canada if you are only exiting to the US. But you may not need to show it though.

May I leave, then re-enter Canada?

In order to return to Canada, you must be in possession of a valid passport or travel document. You also need to hold a valid study or work permit if you are returning to study or work in Canada.

If you are a citizen of a country that requires a temporary resident visa (TRV) to travel to Canada, you will also need to be in possession of a valid entry visa to return, unless:

* you are returning to Canada following a visit only to the United States or St-Pierre and Miquelon; and
* you return before the expiry of the period initially authorized for your entry or any extension to it, either as a visitor, student or worker.

Thanks again! I don't have permission to PM as I am too new :(. Would you please PM him for me? Many thanks!

In the bold text above, the "a visit only to the United States" is killing me, too.

my wife has come back to Canada via US. The officer did not ask much, her first question is how long have you stayed in US.
