I want to sponsor my husband. He lives in the United States but he is not a resident there, at the moment he is there under this protected status. In 2005 he was charged with domestic assault and got a suspended imposition of a sentance and was also given a 3 month probation. In july of 2010, it will be five years since it happened.

I know that legally he can not come here right now. What am wondering is that if he were to come here ilegally and stay here until the time comes when I can sponsor him, will him coming here illegally effect him, will it effect the application in any way. Because i know that on the application they ask so many questions and if he is here illegally how will he explain what he has been doing for the past two years basically.

Any help on this would be great. Thank you very much.

Is there any way that he can come here legally? If I send the application to sponsor him, is there any chance that they will let him come in under a probation or something. He has gone to anger management classes and it was an incident. What are the options so that he can come here before the 5 years are up? If there is a child on the way, those that qualify under one of those reasons that they give, i believe its something like campassionate reasons?

Where is your husband from?, he might be able to go into canada for 6 months as a tourist.

In order for him to come here he needs a Visa, he lives in the United States but is under a Protected Status (its lika refugee status). I spoke to a lawyer today and he said that we can ask the Visa Officer to over ride the rule of him having to wait the 5 years, but I want to know how to do that?
