Help please - applying for PR and Holiday work permit expiring

Hi

Hoping I can get some advice from others in similar situations. I have been living and working in Canada for 5 years on the Working holiday permit/visa. I can no longer apply under this and mine expires on April 9th 2012. My work is trying to apply for a work visa for me but have to do an LMO which they are afraid it will not go through. I am just awaiting my police clearance from Australia to come through so I can send off my Permanent Residency application. I thought if I don't get my work visa that if the visa office receives my PR application before my work visa runs out then I go on implied status. But I just called the immigration line and they told me that I can't do that. If I don't have a work visa then I have to leave the country and I can't work in Canada no longer. I need some advice and help on what to do as I don't want to leave.

First of all, I wouldn't give up hope that your current employer's LMO will be approved. And if that LMO is approved, then this will solve your problem.

If it isn't approved, then I guess you could change your status from worker to visitor once your work visa expires. You would obviously have to stop working but you could start looking for a new employer who would have a better chance of obtaining an approved LMO so that you can apply for a new work permit.

As well - if it comes to that and you have to leave the country, that would not change your eligibility for the CEC class; you can leave the country and if the application is approved, come back as a permanent resident. So don't lose hope.
