HELP! one question of LMIA application form

Dear all,

My employer met a problem when she was filling the form. The cap of foreigner workers is 30% this year in each company, right? my case is if there are 29 employees in our school, that means we can have around 10 temporary foreign workers?

If my math is correct. 30% of 29 is 8.7. Now being as you can't have .7 of a human being. I would say your company is capped at 9 employees. Anymore than 9 and you're over the cap.

34 employes would allow you that 10th foreign worker.

Hi,

The cap is calculated with the hours worked, not the number of employees, as the hours could vary. Also, if your employer currently has less than 30% but above 10%, they're still not able to hire any more workers, as they'll get locked in to their current percentage (so if for example their current percentage is 26%, they get locked in to that). Only way they could hire one (if they are below 30%), would be if a work permit of a TFW already working there is expiring within 90 days and they'd like to replace them.
