Help Needed - Open Spousal Work Permit

Hello,

I have closed work permit valid till Aug 2015. I have already applied my PR under CEC and got AOR last month. I am primary applicant for PR.
Now, I want to apply open spousal WP.

Can I apply it now and What would be the process.

This application will get considered based on my closed WP or based on AOR number? I am bit confused. Need suggestions.

You have a closed WP and YOU want to apply for a SOWP? What would be basis be?

Perhaps you mean you have your CEC AOR and want to apply for an BOWP on that basis? You can, if your current closed WP is due to expire in 4 months or less.

Or do you mean your spouse wants to apply for a SOWP based on your closed WP? This would be feasible too.

Yes, my spouse wants to apply for a SOWP. I have closed WP valid for more than a year.
Should She apply her Open WP based on AOR or based on my closed WP?

Hello rackyy55,

If you applied to the CEC program, your spouse would be eligible for a SOWP based on your closed Work Permit as long as your job is in a Skill Level 0, A or B. If granted, her SOWP will have the same duration as yours.

Check out the cic website and in the Help Centre search for: "can my spouse or common-law work in Canada"

I believe that only spouses of provincial nominees can apply for a SOWP once their PR application reaches a certain stage (i.e. received AOR).

I am submitting online application and here is one question to check for eligibility for SOWP.

Does one of the following apply to you?
• I am subject of a removal order that is unenforceable
• I applied for a study or work permit before entering Canada which was
approved, but not issued at a port of entry; or
• I applied for permanent residence to an office in-Canada and was
determined to be eligible for permanent resident status (first stage
approval).

Is Third point rlated with AOR? is it first stage of Approval for PR? Please advise.
