Help me about marital status

Hello there,


I am little worried about my marital status in express entry profile. well!! We have put our divorced file in India. I am going to get my divorce certificate in April 2017. So, could you please suggest me what would be my marital status in my express entry profile as of now.Legally separated or Divorced.

Unless you have a legal separation agreement you are still married until you get your divorce certificate.

If there is a pending court action for divorce, you are legally separated. The date of separation is usually indicated in the petition for divorce. Choosing the "married" option will complicate your profile.

Keeping in mind that IRCC often has its own definition for many things, here's what IRCC says:

"Separated means that two people are married but no longer living together, and they do not wish to live together again. They may be waiting for a divorce or have not yet decided to divorce."

I would suggest putting "Separated" in your profile. Chances are good that your divorce will be finialized BEFORE you submit an eAPR. If you happen to get an ITA and are ready to apply before then, I would recommend still putting "separated" and provide a letter of explanation. By the time IRCC gets around to asking you for proof of the separation (and they will), you will have finalized your divorce.
