I'm getting started filling out the Application to sponsor and undertaking and I am sponsoring my wife who is a US born citizen. I am a canadian born citizen and we both have a 1 year old daughter (born in USA) together. I've submitted a canadian citizenship certificate for my daughter since she is considered to have rights to both countries. Once I get the certificate will then get her a canadian passport. My question is do I need to put my daughter on this application form or any application form in regards with the family sponsorship process.

Thanks in advance for any replies.

Your daughter will not be considered an Applicant, so should not go on the application EXCEPT the form to fill out additional family members, which asks you to list all children.

Okay so do I add my daughter in the "4. Non-accompanying family members" section?

I also have a son that lives in Canada that lives with my ex-wife and my wife has a daughter that will be staying in the United states with her father. Do these children need to be included in the Non-accompanying family members section?

Your wife's daughter would be in the non-accompanying family members. She will need documentation and a medical done. You would not put your daughter there, as she is a Canadian Citizen.

Your son and the daughter that both of you have would go under Children in the Additional Family Information. This is information about your Wife's family, parents brothers and sisters etc. Under children it specifically states to add her children AND step-children, which of course would be your son.

I hope this helps! The forms can be very confusing!

Yes, she will. Check out the guide about non-accompanying dependents. You will need her birth certificate (copy) and the medical done. If you don't do this and omit her from the application, your wife will NEVER be able to sponsor her to come to Canada, so it is very important!

Thanks for the replies...but we don't plan on sponsoring her daughter because her ex-husband has full custody of the child and we don't ever plan on sponsoring her.

I think that would be a shame. Why cut off her opportunities in the future? You never know what will happen. What if she wants to go to a Canadian University? What if, heaven forbid, her father dies? It is IMPERATIVE that you include her on the application and have a medical done.

Hi i know it sounds like a shame not considering her daughter to come to canada but it's her ex's decision since he has stated No and he has complete full custody of her daughter. Now yes there are things that could happen and god forbid something happens to him and yes we will definately take her daughter and sponsor her if anything does happen however why would we have to pay for medicals now since the medicals expire anyways and would have to undergo new medicals when the time comes to sponsor her daughter. I was reading more in some other forums and there's a sticky post around here that says if the ex does not allow the child to be sponsored then the applicant can write a letter stating that the full custody parent will not allow sponsorship of the child to avoid the medicals.

That's true, but it will cause problems in the future if you need to sponsor her.
,
It's a small amount of money in the grand scheme of things to do it now. I really don't know why they request it, and I think it's ridiculous. Then again, why does my husband have to go through an interview when we submitted 500 pages of evidence of our genuine relationship? We are at their mercy, and all we can do is comply.

You have to include your wife's daughter, even though she is in her ex's custody. If you don't, your file will be returned because it is incomplete. If you don't mention her at all, and CIC finds out, your wife can be banned from Canada for misrepresentation. There are ways to get around including her - the letter - but this means your wife will never be able to sponsor her, even if the father dies and your wife is her only remaining relative. The best thing to do is to include her and get her medical done; in fact it is really the only thing to do.
