Please help me to make them clear!

1) If I do a full time temperary research job as a visiting scientist in Canadian University, based on the contract and work permit I should work 40 hour a week in the lab, but I am paid and supported by Chinese Gov, not by Canadian University. Is it called paid full time work?

2) I had worked continuely one and half years in Canada since Nov, 2008. April 2010, I stopped the work and left from Canada almost 1 year. Now I get a new job offer from Canada. I will return to Canada. After half a year later, can I qulify to have 2 years experience within the last 3 years under the CEC?

2. Yes, if you get the remaining qualified work experience with a Canadian company in Canada.

40 hours per week is full-time. But - did you have a work permit? Did you receive a T4 and file income taxes while in Canada? If you cannot answer yes to these questions, the experience may not count for CEC purposes.

You may have to work 2 years to qualify, if the initial experience is not considered "Canadian employment".

I got NER yesterday from CIO and they said they were not satisfied regarding my arranged employment letter. They said it wasn't specified permanent in my letter. They are going to send my refund in 8-12weeks. Do u have any idea how long does it take for them to send back my documents? Are they going to send it back to my lawyer? Actually my lawyer told me to reapply again, get another letter from my employer with a new format. I need your advice... do i have to apply again, get another letter from my employer but i dont know when can we submit my application again coz my documents still with the CIO. Or do i have to wait till january of next year to apply for CEC. next year of February 8, i will be completing my 2 years skilled position here in canada, which i am qualified for CANADIAN EXPERIENCE CLASS. As we all know that processing time for CEC is only 11 months. What do u think? If i apply through FSW with arranged employment again, probably we can submit my papers probably june coz we still have to wait for my documents from CIO, and then i will be getting response from them probably july. Then, they will transfer my documents to buffalo. As we all know buffalo processing time is taking so long and it say's 17 months. if i go with CEC, end of january 2012 we can submit my application and wait for 11 months. I NEED YOU ADVICE... PLEASE HELP ME...

hey guys, i have a question for you and maybe u can help me. I got NER from CIO yesterday and they said they are going to return my payment in 8-12 weeks. How about my full documents? Are they going to return it back to me or not. Anybody who got NER from CIO? please response to my question.

That's right, the arranged employment letter MUST state that the offer is for permanent, full time employment. I was not eligible under arranged employment because I work on term-limited contracts (renewable, but nonetheless not "permanent" by CIC's definition).

If your lawyer sent the documents, the documents will be returned to him/her.

Eh, sort of.. 11 months is historical data - indicating average processing times for applicants who were approved in 2010 (majority submitted in 2009). We have no idea what processing times would be for you, if you submit in 2012.

Well... if you can afford it and get another set of documents, you can apply to both...

Your assessment of the processing times is about right, so it really wouldn't make much difference which program you applied to... EXCEPT you need to remember that for arranged employment, you MUST have a valid work permit and the job offer must still be valid all throughout the processing and at the time of landing... so for another 17 months or so. If you think that might be a problem, you might want to consider CEC simply because, once you qualify, there are no ongoing employment or residency requirements.

Thank u so much Jes for your advice. i think i will wait till next year of january 2012 and apply for CEC. Do u think the requirements of CEC will still be the same for next year? my category right now is FOOD SERVICE SUPERVISOR NOC 6212, Skilled B.

That is a very good question... I haven't heard of any proposed changes to the CEC program, but that is always a possibility....

It IS a good question. There are never any guarantees or absolutes in immigration but I don't think CEC is going anywhere. It's a very good program. Nothing in the rumor mill at all about this one so I think you are safe.

I have another question again guys. I will be completing my 2 years skilled position (FOOD SERVICE SUPERVISOR NOC 6212) on february 8 2012. But last year i went on vacation to the Philippines for 1 month. This coming July i will be getting 1 week local vacation. Do you think i will be qualified to apply for CEC on feb. 8 2012. but in terms of hours i can make the full 3900 or more than that coz i work 40 hrs. per week and sometimes more than 40 hrs. In our contract in says we are entitled for 2 weeks vacation per year. I need you advice. Do i still need to wait and renew my work permit and work to replace the vacation days? When can i apply?

If it is paid vacation and you remained employed during this time, you do not have to "deduct" vacation time. (if it were an unpaid leave of absence, that would be different.)

It does not matter in your case, but you cannot use beyond 37.5 hours per week to count your time... (3900 is the "full-time equivalent" goal for part-time workers; does not really apply if you were full-time).
