Help!!! Can my Aunty sponsor me to Canada?

Hello Guys, I am sorry for your precious time to read my message, my status is as below: I am from China and I am 36 years old, I got married and have a 5 years old daughter. My aunty's status is as below: her husband, parents and grandparents passed away, there is no relative in Canada with her, and she has no children. Her income per year is about 43,000CAD. Can she sponsor me to Canada? She is very longly now and she has no one relative in Canada, but she has brothers and sisters who are over 60 years old in China. I just want to know whether she is eligible to sponsor me to Canada. As I have seen some immigration policy as below:

You can sponsor one relative regardless of age or relationship only if you do not have a living spouse or common-law partner, conjugal partner, a son or daughter, parent, grandparent, sibling, uncle, aunt, nephew or niece who could be sponsored as a member of the family class, and you do not have any relative who is a Canadian citizen or a permanent resident or registered as an Indian under the Indian Act.

This topic for me is a bit unclear and I don't know anyone who's been through this type of sponsorship. As you can see from the text you quoted, siblings, nephew and nieces "could be sponsored as members of the family class".

So if she doesn't have a husband, children, parents or grandparent alive, I think the next in line are siblings. The fact that she has brothers and sisters in Chine might be an impediment for you. But I'm really not sure how it works and which family member has priority at this point. I would think that her siblings, uncles and aunts have priority for a sponsorship over you.

If I were you, I would call the CIC call center to get more information. It's best to confirm it with them, there is a slight chance she can sponsor you, but don't take my word for it. Inform yourself through a lawyer, CIC, etc. Try all means necessary before you make a decision.

I am leaning towards Avadava's post. As long as her siblings are alive, they takes precedent over you.

I think her situation may warrant a special situation based on her case. Your best bet is to contact CIC and see if she can qualify to sponsor you.

Thanks both of you, please see the below policy, it seems that if the brothers and sisters are over 18 years old, my aunty can not sponsor them, please view, I am very confused about this as well, my application has been sent and I just wish for the best now:

I don't want to be mean, but there are high chances your application will be refused based on the fact that you do not qualify as a member of the family class.

Yes, Sir, they are alive, but please note the words of "who could be sponsored as a member of the family class", as they are over 18 years old and they are not the orphan, so how can they be sponsor as a member of the family class?

If she has living siblings ( regardless of her not being to able to sponsor them as they are 60 ), she cannot sponsor. This rule is basically when she is all alone and no trace of any

living spouse or common-law partner, conjugal partner, a son or daughter, parent, grandparent, sibling, uncle, aunt, nephew or niece

regardless of wherever they are in the world

The discussion is not that he can sponsor. He is asking if his aunt can sponsor him as his aunt is alone in Canada.

His aunt has living siblings which does not allow her to sponsor him under special conditions as it listed "no living siblings" in order for his aunt to sponsor him.
