I have been living in Toronto for 3 years now. I arrived under the Youth programme from Australia. I applied for restoration of status in January, however was denied because I had no Lmo. My empoyeer applied for an LMO which took 5 months to be processed, the work permit i had applied for was again refused because they couldnt wait any longer for the LMO. I then recieved my positve LMO. I proceeded to reapply for Restoration of status in June. With my positive LMO. Throughout this process I have been working with my local Member of parliament, who has been advising me along the way, to ensure that everything is being done correctly. In September I recieved my entire application back saying I didnt pay the incorrect fee. However we had checked online to ensure the correct fee was paid. Before i resubmitted my application I had asked my mp to please check I had completed this correctly, I was assured this was the case, he had even checked online to ensure all was correct. I then resent my application again in September. Im still waiting for this recent application. Im so crushed that I have to rewait again over something like a fee payment. If thats all the issue was then couldnt a phonecall of been made? Its now December, my grandmother has had 3 heartattacks and now a stroke. I want to go home and visit, however because I have implied status I cant leave and then come back to work. I have worked so hard since arriving to Canada and have acheived so much in my career. Id love to be able to continue with my career, however I need to get home to visit. I feel so torn.

I would like to know: Can I go home and reapply from Australia for a brand new work permit? If so how long would this process take? Is there any other options other than just waiting your turn in line for your application to be processed?? grateful for help ;-)

1. The MP obviously didn't understand the restoration process. Your work permit expired in January, you had 90 days to restore. You didn't leave Canada once you were refused, so you had no status. I hoped you didn't work during this time, as it means you will be barred from obtaining a work permit for 6 months after you exit Canada. You couldn't apply for a second restoration, just to repeat 90 days had passed. You don't have implied status, that was long gone as you got the refusal. Implied status only occurs when you are waiting for a decision from CIC. You got it, and didn't leave.

The application I originally applied for in January was an extention of status. When applying I thought that this would be adequate time to allow processing of my extention and Labour Market Opionion prior to the expiry of my current work permit. I remained beyond validity of status because I had logistic challenges with my application. My extention of status was refused because of not having a valid lmo. My employer submitted an LMO application in January.
