HELP ABOUT SPONSORING

Im a permanent resident currently living here in Edmonton,Alberta, ive been here for almost 7 months now.. I just wanna ask if what is the fastest way or best way to be with my son and his mother? They are both in the Philippines right now,.i declared my son when i came here,his name is on my c.o.p.r (non-accompanying status) but his mother and i are not married.. Pls help

By any chance did you live with "the mother of your son" for 12 continuous months before coming to Canada?

Assuming you never lived with you girlfriend for 12 consecutive months at any time, the quickest way to sponsor both of them will be to fly to Philippines, marry her, return to Canada and then sponsor them for PR. During processing you would need to reside in Canada.

It would be even better if they applied for and were granted TRVs to visit Canada, in which case you could marry her in Canada and apply inland for their PRs so they would have implied status and be able to stay here with you during processing. Of course the chance of them being granted TRVs is most likely pretty slim.

Actually that's not good news. Assuming your common-law spouse is "undeclared" (on your own application), she is forever excluded from being sponsored under the Family Class.

(because 12 continuous months of cohabitation means you are common-law spouses)

I just dont get it, when im back home, one of my requirements is not to be married in order to come here and become p.r but i need to declare that i have a son, they made the "mother of my son" sign some proof or documents that
We are not living together
She is allowing my son to travel with me
and lastly they asked for a CENOMAR.
so i passed everything and now im here, how ironic if the reason i cant sponsor her is because she isnt declared as my partner and yet it was the same reason i passed the requirements thats why im here today..

Unless u mean i failed in the "common law partner" thing but still eligible for the "sponsor thing" ?

What the others are asking.. When you originally applied for your own PR. On you application did you include your spouse and your child's name on your forms?

Ah, that's why! Yes, if you were married or 'living together' for 12 months or longer, then yes you would be disqualified from being sponsored by your mom. Unfortunately, you have disqualified your GF (really your common-law spouse) from ever being sponsored by you.

It's not ironic, now that you mention it. For the CIC, it's quite intentionally the penalty for what they call "misrepresentation".

Do you understand that you, and your mother as the principal applicant, committed fraud to obtain your PR status? CIC can revoke your family's PR statuses for that.

Its not his mom its his spouse.."mother of his child"




Did you get your PR on your own or did you apply through an agency originally?
