in 2014 i gave birth and i send the birth certificate to cic recently and now they want to know my matrimonial situation

No - there is no law stating that you have to live together for 12 months to be considered married. You are confusing married with common law status. You should have said you were married when you applied for the student visa. You should let CIC know that you are married. Saying anything else would be misrepresentation / lying.
