My husband got the nomination after his work permit expired, so does mine.
I applied for a work permit on the basis of his papers, support letter, nominations, the old work permit and certificate of marriage)
This morning I recive that my application for a work permit is rejected officer said, "I am not satisfied that you fulfill the necessary conditions ....." and states that I do not have the right to the restoration of the status, because my status on the restoration of expired which is not true my status after the expiry of the work permit is still in progress as of 90 days.

Please help before I call CiC.
 
You need to provide more information. When did your work permit expire? When did you submit the extension application?
 
Please don't bump your post - this is rude behaviour. It's been less than an hour since you posted. People offer advice on this forum for free. This means you sometimes have to wait several hours (or even days) for a response. If you want or need an immediate response - please hire a lawyer.
 
I agree it's rude, but lot of people do it, and so I did it to, see the first post, he bumped his post after couple min.

1. Since your husband received a nomination, that doesn't mean that you can use it for your WP extension. It's his nomination, so only valid for his WP.
2. Restoration is a separate process to WP extension. A person whose permit has been expired, should apply BOTH restoration and permit extension.
Clients who submit an application to renew their status after it has expired, but within the 90-day restoration period, will receive a notice from CPC Vegreville warning them to apply for restoration. Clients will have 90 days from the date their status expired to submit their restoration application and corresponding fee.

So, here's the thing:
1. Your husband should apply for WP extension AND restoration as a nominee.
2. Before/after he receives his WP, you may apply yours as a open-WP applicant for a spouse. Indicate the whole situation and your husband's application info (app# and client id) on your cover letter.

Suggestion:
HIRE A IMMIGRATION LAWYER. Restoration is only allowed in a limited time (90 days). Regarding the CIC processing time, I would say this is one time chance. Consult a law firm, which has both lawyer and certified representative.
 
Thanks for answer and advice I did contact immigration consultant and will hire him, its the best way, you are right.
