Dear Members
I request advice from members who have attended Hearing for Residency.
I have landed in 2009, then applied for Permanent residence Card renewal in 2014, without meeting 2 year stay criteria. I have stayed less than 200 days. I left Canada to take care of parents.
In 2016, I wanted to return to Canada, I was asked to apply for PRTD, which I did. After 3 months I got reply with rejected PRTD for me and my wife. My children both who are now over 18 years, got PRTD and got PR cards valid for 5 years and they joined in Canadian University.
After appealing in time, I was allowed to enter Canada. Since 6 months, I am in Canada and I got letter for hearing in May 2017. I am trying to gather documents for H&C grounds.
I did not engage any lawyer as they are expensive and not giving any guarantee.
Can any one advice how to proceed for favorable outcome from hearing in my case?
Thank you for reading my case.
Best Regards

Do both your parents have a documented medical condition that required you to care for them? Are both your parents still living? What evidence did you already provide as part of your PR TD application what was rejected?
As part of the appeal hearing you may be expected to show their medical records, hospital stays, and doctors notes that showed it was necessary for you to live in home country for them. You may also need to show there were no other family members (your brothers/sisters, etc) living in your home country, else IRCC may expect other family to have cared for them.

If they were simply old and you decided to stay with them, that will most likely not be seen as suitable H&C reason to not meet the residency obligation.

It's quite common that PRs who were removed from Canada while minors, will get PR TD's easily approved as long as they apply shortly after turning 18.

I thank Rob and Crewbunk for your time and responses.
My mother was not well and she expired in 2016 Feb. I applied for PRTD in April 2016. I have some medical records for mother since 2012 which I am sending for hearing.
My father is aged, above 80 managing with difficulty.
I have hearing in May 2017. I am trying to go without any lawyer.
If you have any experience please advice if I am doing right.
Regards

So you are ok to now leave your father all alone in your home country if you got your PR renewal approved on H&C grounds?
