My wife have been working with employee on Co-op for 16 month and after her Co-op finish since i was working there too , we trust the company owner as he told my wife keep working as full time employee , she did not got paid for about 4 months and company didn't gave her contact since Sept to end of December in 2022.
she have been paid for all 4 months in feb 2023 but as bulk money and company did not pay EI and pension and tax to government and just send her bulk money and we did that part of money for tax return as self employee income.
she keep working there all these time and she got contract in jan 2023 and keep working as full time contract. in August 2024 company change their name and rebrand and force everyone to have sign a new contract with new company name.
we are in British Columbia and my wife did not user any of her vacations during the last 3 years. so my question is for Vacation rule, is this company suppose to pay her at the end of each year since she did not use any day off ?
can we Sue company because of not doing paying the pension and EI to government and asking for work without contract and without payment.
