Hi
I need your advice. Just to briefly tell you about my situation,
I am currently separated, on the verge of divorce from my canadian wife. We have a 2 year old daughter who is very sick with multiple health issues (living with her mother). Since i am not going to apply through my wife; and since my daughter needs extreme attention and care of two persons (in this case both parents) and i want to be there for her, i want to know if i can apply as a parent or any other humanitarian based option? Taking into consideration that my daughter is having a rare disorder and require lot of support and attention.
I am financially reasonably sound. So i would request experienced members or members who are aware of such special cases, if you can guide me about my options.

Your first step is to apply for a TRV to visit Canada (assume that's where your separated spouse and child are currently). You can explain the reason for your visit to Canada in your application.

If the TRV is refused, unfortunately you will just need to keep addressing the reason for refusal and try again.

If TRV is approved, then you can come to Canada as a visitor only. Once in Canada, you can then talk to immigration lawyers experienced in H&C cases to see if your situation has any chance of getting you PR status based on H&C. I don't think your situation qualifies for getting PR status, but really each case is unique so a lawyer may be able to offer more insight. At the very least, you can try to extend your visitor status every 6 months as needed to stay with your daughter.

Note that in order to submit a H&C PR application, you must be physically inside Canada. Hence the reason the TRV must first be approved to have any chance. Good luck.

I got my TRV, valid for 2 years. But the problem is i cant get a job on TRV status and to stay there for longer period would require me to leave my job here. To be jobless and be in the situation i am, will make the situation worst. So this is the dilemma.
I came to this forum to seek advice regarding the options that i can avail and then intend to go to a lawyer or a consultant to pursue further.

To apply through H&C, you do need to be physically in Canada (and would need to remain in Canada). The H&C process also typically takes a couple of years to complete.

If remaining in Canada for two years but not working is not an option, then I don't think H&C is the right route for you (it's also quite difficult to be approved). I would instead investigate if you can qualify to immigrate through an economic immigration stream like Express Entry/FSW that would allow you to apply from outside of Canada and continue working outside of Canada until a decision is made. Another option would be to obtain a work permit. However in order to do this, you need a full time job offer and approved LMIA from an employer in Canada. This tends to be quite difficult to do.
