Hi,

I'm currently on an open-work permit due to expire on October 10th. I applied for an extension to this permit well outside the 30 day period, citing a full-time employment contract with my current employer. I was told that, due to the current wait times, this would only be processed after my current permit is due to expire but that I would be on Implied Status until then.

However, my current employer is now apparently likely to fold its business within the next two months. Should that happen, what would my legal status be, both before my application has been processed or after? Given that my current work permit is an open one, is an extension regarded as simply an extension of an open work permit or, given that I cite my current employment, would the extension be tied to their business? I have also been working as a freelancer (I'm a software developer) on the side - how would this be affected?

If you applied for a new open work permit (what category would be interesting) and it is approved, then you don't require an employer.

I'm not sure I understand - I applied for an extension, rather than a new permit. Are you saying that my best bet now is to apply for a new permit?

No, the question was on what basis are you eligible for an open work permit. If you are eligible, then you just apply for an OWP, you don't require an employer.
