Got valid work experience using visitor VISA, is it countable?

Hi guys,

My wife had a visitor VISA but she was doing full time work to an employer not in Canada. In this situation, Canada Immigration said she doesn't need a work permit. We paid taxes for her income in Canada. Can I use this experience for immigration using CIC ?

No, not for a CEC application.

We are in a process to get a work permit for her. AFTER we get the work permit, can she use this experience for CEC, given her employer is not in Canada ?

You'll have to explain more - is she self-employed and working at home for a foreign employer? Then, no, self-employed experience does not count. For CEC, they are really looking for experience in a traditional employer-employee relationship, IN CANADA. Nevermind that it's an anachronistic view of working arrangements...

as far as I understand, in Canada a person who works from home for an employer outside canada is not considered self employed. The difference, as defined by Canada Revenue, is a self employer can select his assignments as he like while an employee should follow instructions from the employer. Canada Revenue controls that because the taxes for a self employed person is lower and also he can count every thing as an employment expenses like rent, phone bill, internet bill, ... and so on.

I think she is not considered a self employed but the trick is whether paying taxes considered a proof of legal work with a confirmation from employer or not!!

CEC is Canadian experience class, If she was not working for Canadian employer, I guess you can not count this experience for CEC. You can always count this for FSW and other PNP, but as best of my knowledge not for CEC.
