Got Study permit but not attending school

Hey guys,

I came in Canada since 2011 and after completing my education in 2013 I got PGWP which got expired in August 2016. After I apply for study permit which is valid from October 2016 for 2 years course which will expire in October 2018. I applied for CEC in December 2015 and was qualified for an invitation to apply for my PR in April 2017. My situation is that now they are asking for my evidence for attending school the problem is I didn't attend school.

Is there going to be any issues regarding not going to school or will it lead to refusal or cancellation?

Any information regarding my situation will be big help.

I'm sorry to say, this is not good news...

If you obtain a study permit but do not attend the school, you will be reported by the school. Your study permit is automatically cancelled, and that means your stay (maybe also work) in Canada was not authorized. You could be deported... Would suggest leaving Canada before that happens...

As explained above - you've got a problem on your hands. You're in Canada without status. Hopefully you haven't been working since your PGWP expired. If so, you've been doing so illegally.

Hi guys,

Thanks for the info, but I am not working at this moment and not going to school as well but got an invitation to apply for PR and now hopefully I will apply in the first week of May 2017.
Is still going to be a problem? Or what can I do now to save my status?

To the best of my knowledge you cannot apply when you're out of status - and you are out of status. Your study permit will have been automatically canceled when you failed to attend school which put you out of status in Canada. Best option is to leave Canada and submit your application from outside of Canada.

It's probably too late to restore your status from within Canada. Even if it isn't too late, you would need to submit the restoration application and wait for it to be successfully processed before submitting your PR application. Restoration applications can take months to process.

Again, the best (most likely only) option is to leave Canada and apply from outside of Canada.

Yes - as I already explained in my post above, you can apply to restore your status. You'll need to wait until the restoration application is processed, approved, and you are back in status before you'll be able to submit your PR application.

There are two reasons why leaving Canada is a better option that applying for restoration. The first is that restoration often takes several months to process. The second is that it may be too late for you to apply for restoration in which case you may end up waiting for months only to be refused and have to leave Canada anyway.

how you ended up getting your PGWP if you did not attend the school at all? i think it is impossible to get pgwp without completing your program---first of all?.... :eek:

Read the OP's post again. OP obtained a study permit, attended school and qualified for a PGWP. After the PGWP was completed, OP obtained another study permit - but then didn't attend school.

My question is, who are asking you to show the proof that you were attending school? As you said You haven't even applied for the PR yet. And does anyone notify you that your study permit has been cancelled?


I have one more question for other members . How would a student know that if he/she had been reported by the school? Will they get an email from cic in their mycic account? or will they be notified by the school? How would they know if the study permit has been cancelled or lapsed??

No - they won't be notified by either CIC or the school. A student should assume their study permit has been automatically canceled and they're out of status in Canada if it's been more than 90 days since they stopped attending school. Schools are required to report the status of students to CIC and confirm whether they are still active students or not.

you are right scylla!

as soon as someone graduates from a University that person will have 90 days of grace period where it allows a graduate of a University either to apply for a pgwp and/or back to the home country (only international students), and/or continue studies at a different level. The schools must report regarding the status of students to CIC; otherwise, the school might trespass rules/regulations established by the CIC.

It is always advised to follow the rules set by CIC otherwise that person might in a huge trouble ending up getting deported, which not OK....

He don't be able to apply for restoration sińce he passed 90 days period after his previous work permit expired.
